NOTICE OF DEVIATION Carolina Power and Light Company Shearon Harris Unit 1

Docket No. 50-400 License No.

NPF-63 During an NRC inspection conducted on Harch 20 - April 16,

1993, a deviation of a written commitment was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C, (1993),

the deviation is listed below:

Regulatory Guide 1.33, guality Assurance Program Requirements (Operation),

Appendix A, paragraph 9.a states that maintenance that can affect the performance of safety-related equipment should be properly preplanned and performed in accordance with written procedures.

The Final Safety Analysis Report, paragraph 1.8 describes the extent to which the licensee complies with Regulatory Guide 1.33 and states, in part, that maintenance shall be preplanned and performed in accordance with written procedures except in emergency or abnormal operating conditions where immediate actions are required to protect the health and safety of the public, to protect equipment or personnel',

or to prevent the deterioration of plant conditions to a possible unsafe or unstable level.

Contrary to the above, non-emergency safety-related maintenance activities were commenced on Harch 14, 1993, to troubleshoot the "A" emergency diesel generator control panel without appropriate pre-planning.

Please provide to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, in writing within 30 days of the date of this Notice, the reasons for the deviation, the corrective steps which have been taken and the results

achieved, the corrective steps which will be taken to avoid further deviations, and the date when your corrective action will be completed.

Where good cause is shown, consideration will be given to extending the response time.
