c ~ g Docket No.

50-400 September 28, 1990 Mr. Lynn W. Eury Executive Vice President Power Supply Carolina Power 8t Light Company Post Office Box 1551 Raleigh, North Carolina 27602

Dear Mr. Eury:

SUBJECT:

TEMPORARY WAIVER OF COMPLIANCE - SHEARON HARRIS NUCLEAR POWER PLANT, UNIT 1 (TAC NO. 77664)

By letter dated September 27, 1990, you requested an emergency Technical Specifications (TS) Amendment for the auxiliary feedwater surveillance requirement for the motor-driven pumps recirculation flow discharge pressure at the Shearon Harris Nuclear Power Plant, Unit I (Harris).

The current TS surveillance requirement 4.7. 1.2. l.a. 1 requires that each motor-driven pump be verified to develop a discharge pressure of greater than or equal to 1590 psig at a recirculation flow of greater than or equal to 50 gpm.

You requested that this condition be revised to require that the pressure differential across the pump shall exceed 1558 psid at 50 gpm or greater for 70'F water temperature in the condensate water storage tank (CST).

Your request was based on the supporting technical information in your September 27, 1990, request for a license amendment to permanently change the affected TS.

We have reviewed the Request for Temporary Waiver of Compliance in your September 27, 1990, letter and find it acceptable.

Therefore, we confirm the requested Temporary Waiver of Compliance, which was verbally granted on September 28, 1990.

A marked-up TS 4.7. 1.2.1.a.l for Harris is enclosed.

This temporary waiver of compliance shall be effective immediately and shall remain in effect until the NRC staff completes processing of Carolina Power Im Light Company's request for an emergency TS Amendment dated September 27, 1990.

Sincerely, 90l 01 00079 900928 PDR ADOCK 05000400 P
