ENCLOSURE 1

NOTICE OF VIOLATION Carolina Power and Light Company Shearon Harris Unit 1 Docket No. 50-400 License No.

NPF-63 During the Nuclear Regulatory Commission (NRC) inspection conducted on November 21, 1988 - January 20,

1989, two violations of NRC requirements were identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violations are listed below:

10 CFR 50 Appendix B, Criterion XI, states in part that a test program shall be established to assure that components will perform satisfactorily.

The test program shall include operational tests during nuclear power plant operation.

Test results shall be documented and evaluated to assure that test requirements have been satisfied.

-Management Manual Procedure OMM-003, Rev.

2, Section

5. 1.1,
entitled, "Equipment Inoperable Record," requires that the shift foreman will review completed work request (h'R/JO) packages to ensure that all related post maintenance test requirements are satisfactorily completed.

The Shift Foreman documents in steps 18 and 19 of the Equipment Inoperable Record Form OMM-003-1 that testing required to restore components to operable status, has been completed.

Contrary to the

above, on September 28,
1988, post maintenance testing requirements of checking motor rotation and monitoring for unusual noise or vibration for room cooler AH-26 (1A-SA) were not performed.

This resulted in failure to detect disconnected fan motor leads and caused the associated train of the Reactor Auxiliary Building Emergency Exhaust System to be inoperable from October 5 to December 5, 1988, when required to be operable by Technical Specifications 3.7.7 and 3.0.4.

This is a Severity Level IV violation (Supplement I).

Technical Specification 6.8. la requires that written procedures be implemented covering the procedures outlined in Appendix A of Regulatory Guide 1.33, Rev.

2, February 1978.

Administrative Procedures are identi-fied in Appendix A of the Regulatory Guide.

002, Rev.

3, Section 5.4, entitled, "Plant Conduct of Operations,"

requires that adherence to procedures shall be mandatory.

2, Section 5.2, entitled "Clearance Procedure,"

requires that when removing a clearance, remove tags from handwheels of all valves, as

required, and reposition manual valves as directed in the restoration line up.

NPF-63 Contrary to the

above, on January 17,

- 1989, at 2: 15 a.m.,

the valve realignment instruction in clearance OP-89-0071 was not followed in that valve 1SF-19 was required to remain closed.

Valve 1SF-19 was opened which allowed approximately five feet of water in the spent fuel pool to drain into the new fuel storage pool.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN:

Document Control

Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, Shearon Harris, within, 30.days of the date of the letter transmittin'g this Notice.

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:

(1) admission or denial of the alleged violation, (2) the reason for the violation if

admitted, (3) the corrective steps which have been taken and the results
achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.

Where good cause is

shown, consideration will be given to extending the response time.

If an adequate reply is not received within the time specified in this

Notice, an order may be issued to show cause why the license should not be
modified, suspended, or revoked or why such other action as may be proper should not be taken.
