ENCLOSURE 1

NOTICE OF VIOLATION Carolina Power and Light Company Shearon Harris Unit 1 Docket No. 50-400 License No

NPF-63 During the Nuclear Regulatory Commission (NRC) inspection conducted on February 20 March 20,

1988, a violation of NRC requirements was identified.

The violation involved failure to follow procedure.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1987), the violation is listed below:

Technical Specification 6.8. la requires that written procedures be implemented covering the procedures outlined in Appendix A of Regulatory Guide 1.33, Rev.

2, February 1987.

Administrative Procedures are iden-tified in Appendix A of the Regulatory Guide.

An Administrative Procedure titled "Procedure Review and Approval," AP-006, Rev.

7, Sections 5.7 and 5.8, requires that Emergency Operating Procedures must be technically accurate to safely perform their intended function.

Contrary to the

above, from September 24, 1986, until December 10,
1987, AP-006 was not implemented in that an Emergency Operating Procedure EOP-EPP-010, titled "Transfer to Cold Leg Recirculation" was not revised to include the valve configuration described in FSAR Table 6.3.2-6.

Failure to revise the EOP to ensure that a single RHR pump would perform its intended function while operating in the recirculation configuration could have resulted in a total loss of RHR during a

LOCA condition.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provision of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including:

( 1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when gull compliance will be achieved.

tlIhere good cause is shown, consideration will be given to extending the response time.

Security or safeguards information should be submitted as an enclosure to facilitate withholding it from public disclosure as required by 10 CFR 2.790(d) or 10 CFR 73.21.
