iiAgiii In your January 16, 1987 letter to Carolina Power &, Light Company (CPRL) concerning our request for exemption from 10 CFR 171 annual fees for the Shearon Harris Nuclear Power Plant (SHNPP 7 CPttcL was instructed to discontinue making quarterly payments until a decision concerning the exemption request has been made.
Specifically, CPttt:L was to withhold payments for the second and subsequent quarterly invoices in Fiscal Year 1987.
Please note that the second quarterly bill was paid pr ior to receipt of your January 16 letter. (Reference CPRL confirmation Letter NLS-86-061 dated December 31, 1986 for NRC Invoice No. F0385).
In light of the NRC's suspending CPRL's liabilityfor fees until ruling on the exemption request, CPRL requests that the fees previously remitted be returned pending final NRC action on the exemption, This would result in a return of $ti12,623 from payment of first and second quarter invoices (Nos. F0371 and F0385, respectively).
Carolina Power 2 Light Company acknowledges that this return would not constitute approval of the aforementioned exemption request.
After the final NRC decision and subsequent notification, CPtttL willremit the appropriate fee payments.
Carolina Power R Light Company also understands that interest on withheld payments willaccrue only after notification of a decision and that terms for payment shall be consistent with those of previous 10 CFR 171 quarterly bills.
