We have received your December ll, 1986 application for exemption from the annual fees of 10 CFR 171 until such time as the Shearon Harris Nuclear Power Plant achieves commercial operation.
Your application and stated contentions will be reviewed as soon as possible.
As indicated in the terms and conditions of the invoices which have been sent to you for the first and second quarterly payments, and as your letter recognizes, the filing of the exemption request does not auto-matically extend the due date for any quarterly payment, and we note that you have remitted the first quarterly payment.
While exemption requests do not extend the due date of a quarterly payment and while we have not yet made a decision on your exemption request, your Company should not make payment on Invoice No.
F0385 for the second quarterly bill and any subsequent FY 87 quarterly bills on Shearon Harris Unit No.
1 until further notice is provided to you.
At such time as a decision is made on your December ll exemption request, it will be provided to you in writing and you will be informed about further quarterly payments.
If any exemption is granted to you which necessitates an adjustment to an invoiced amount, such adjustments will be made including refunds, if necessary.
