Dear Senator Broyhill:

I am pleased to respond to your letter dated October 16, 1986 which was addressed to Chairman Lando W. Zech, Jr.

and which has been referred to me for reply.

Attached to your letter were letters from some of yo'ur constituents (Ms. Jetter, Mr. and Mrs. Wiggs, Colone'I and Mrs. Henry Katz, Ms. Holm, Mr. Elliott, Ms. Lindeke, and Ms. Helmer} who expressed their concerns regarding the Shearon Harris Nuclear Power Plant, Ilnit 1 Fmergency Preparedness Plan (EPP).

The following concerns or comments were expressed by your constituents:

Carolina Power 8 Light Company's

{CP8L) exemption

~equest not to conduct a full participation test of the Emergency Preparedness Plan within twelve months prior to the issuance of' full power license should be denied.

Substantial changes have been made and others are anticipated to be made to the, Emergency Preparedness Plan since the last full participation test was conducted in May 1985, thus another full participation test should be conducted prior to the issuance of a full power license.

Concerns about the adequacy of the Emergency Preparedness Plan were raised as well as concerns on whether or not the plan would be rewritten as CP8L and the North Carolina Department of Crime Control and Public Safety assured the county and municipal governing bodies in Durham, Orange,

Lee, and Wake Counties.

The emergency siren alarm system was not fully tested and the two inadvertent actuations of the sirens further demonstrate the inadequacy of the plan.

Regarding the possible exemption from conducting a full participation test of the EPP within one year prior to a full power authorization, the staf+ has reviewed CP8L's request and has prepared a safety evaluation report supporting the grantinq of the requested exemption.

The request for the exemption is pending for decision by the Director of the Office of Nuclear Reactor Regulation.

Another

issue, whether a hearing should be held thereon, is currently pending before the Commission.

With respect to.the changes in the

EPP, we know of no substantive changes in the emergency plan or its implementation which have resulted from the ItIay 1985 exercise.

The Federal Emergency Management Agency (FEMA) has determined that deficiencies noted during the May 1985 exercise did not detract from the overall state of readiness and could be corrected through training and additiona'I resources.

The State has conducted approximately 15 training courses to help maintain emergency preparedness for State and county personnel.

Local counties are also conducting training programs in radiation for local hospitals, and in damage assessment and shelter management.

In September 1985, the plant, State, and counties began participating in monthly communications drills to test the notification system and the reading of messages by plant personnel to State and local warning point personnel.

The Honorable James T. Broyhill In November 1985, Harnett County conducted a hazardous materials release drill with local hospitals.

A hazardous materials incident exercise is also planned in Lee County.

Regarding the adequacy of the plan, a

new revision of the State Plan, which includes County plans, was issued on October 13, 1986.

A draft of the State Plan was reviewed by the County Emergency Management Coordinators in Chatham,

Harnett, Lee, and Hake counties, as well as other local officials.

The plan was approved by all counties with the exception of Make County, which is expected to approve the plan in the near future.

The other issue raised was the inadvertent actuation of the sirens in May 1985 and June-July 1986.

The first actuation is judged to have been caused by lightning and the second actuation, according to CPSL, was caused by vandalism.

CPRL stated that in a real emergency they would promptly notify offsite authorities using dedicated phone lines, not the sirens.

These offsite authorities would in turn decide whether to sound the sirens by activating them remotely from central locations in each of the four counties in the EPZ.

Thus, in the event of an actual emergency, both onsite and offsite authorities would'e fully apprised of the activation of the siren system.

I believe your constituents are perhaps referring to the formal review by FEMA who will analyze a year of accumulated data collected from these tests, which CPSL plans to submit in the near future.

FEMA, upon completion of their analyses, will conduct a full-scale test of the siren system to verify its effectiveness and will include a survey of the public within the 10 mile emergency planning zone.

This test will occur in early 1987.
