CXQE, Carolina Power & Light Company December 19, 1979 Mr. Harold R. Denton, Director Office of Nuclear Reactor Regulation United States Nuclear Regulatory Commission, Washington, D.C.

20555 SHEARON HARRIS NUCLEAR POWER PLANT, UNIT NOS. 1, 2, 3, AND 4 DOCKET NOS. 50-400, 50-401, 50-402, AND 50-403 TENDERING DATE

Dear Mr. Denton:

In response to a request for information made by Mr. Olan Parr of your staff, the following information is provided.

The Shearon Harris Nuclear Power Plant (SHNPP) Final Safety Analysis Report for Units 1, 2, 3 'and 4 will be sub-mitted or or about June 1, 1980.'his submittal is scheduled to support issuance of an operating license for Unit 1 in June,'983.

These schedules are the same as those reported'o you in our letter of December 21, 1978, a copy of which is attached.

We believe it important that this information be relayed to the NRC Office of Management Program Analysis (OMPA), since the November 16, 1979 Program Summary Report (NUREG-0380) does not show our FSAR submittal in June, 1980. It is our understanding from discussions with NRC staff personnel in OMPA, that the NRC is not expecting our FSAR to be filed before a 24-30 month'perating license review period by NRC.

At a meeting with you on December 13, 1978, and in my letter of December 21, 1978, CP&L discussed our reasoning that a 36-month period was considered appropriate for the SHNPP OL review.

We would like to again restate the importance of NRC assigning a high priority to the SHNPP OL review to support a June, 1983 OL issuance for Unit l.

If you need any additional information, or would like to meet again to discuss this matter, please do not hesitate to contact me.'LB/j cb Enclosure cc:

Dear Hr. 3oyd:

On ~ieger 7, 1978, you forwarded Ca us a request to identify ail spplicstions sad requests for review which ve plan Co submit to the XE prior to Decaaber 31, 1981.

This schedule reflects ao chaava from our previous response to your last survey, to which ve responded on February 10, 197."..

It is i~tant to emphasize that our submittal 36 ~ths in advance of the data by Mich an operating license is requirH is well supported by historical data and by ycnn'ro)ected

'.KC staff renew times.

As you indicated during ouz December 13

meating, the

'.PcCC staff is ace anticipating i 26-to 23~th time period from date of docket to date of ACRS letter.

To this CMe period ~st be added the pre-docket review Cim end the time between ACRS latter and issuance of the operating license.

h survey of recent PSARs and VSARs shows an average pze' docket review time of apprmhnatsly niae weeks.

A sMilaz review of recently licensed pLmts (operating licenses) shows an @vera~a eIspsed ti~ between ACM latter snd issuance of Cho operating licaasa of 5.5 oaths.

Mding chase CMe requirements Co a 28-couth docket'to-ACRS ti a fr@~a supports e total elapsed time of 36 months.

Zn view of t'e anticipated intervention during Cha SHNPP public hesrinp for OL, mad Chi fact that raccnt pIant operating license reviews have far axceeded the 36~ath period, we request Chat you assign the SUPP OL review e high priority.

Construction of Che Shearoa orris !luclsaz Power Plant is ~ing along extreuely well, utilizing two shifts, wiCh aa expected coapletian Rata for Unit 1 fuel losdin8 of Juan, 1983.

Our construction pzogress is closely monitored and should any situation arise that would indicate Chat the June, 1983, Unit 1 canpletioa date may be )eopardized, we will respond by edifying our construction plea in order to insure thet the June, 1983 complecian date will be. achieved.

December 21, 1978 In support of this construction effort, it is absolutely vital that the operating license for Unit 1 be issued by June, 1983.

We are available to meet with you and discuss this schedule and our project status, if desirable, in order to assure appropriate placement of the SHNPP OL review on your "priority" listing.

Yours very truly, QR~gtgAg stGHEo QYi g, A, McOUFEg N. A. NcDuffie
