lfe have completed a review of certain applications for license amendments and other approvals which your Company has filed with the Office of Nuclear Reactor Regulation (ONRR) for review in connection with Turkey Point Plant Unit Nos.

3 and 4.

As a result of this review, we find that fees pursuant to 10 CFR 170 have not been paid for several applications which were filed prior to June 20, 1984.

He also find that in a few instances the fees paid were not adequate.

Consequently, we have enclosed a list which shows the application dates, fees paid, fees that are applicable, and ONRR's fee determination on each of them.

Based on the ONRR staff's fee determinations, a total of $28.800 is due the USNRC for the applications on the 'list.

Therefore, you are requested to re-mit this amount to our office. If the ONRR staff's final reviews of Items 2

through 8 of the enclosed '1ist reveal that these fees are not appropriate, you will be notified and any necessary adjustments will be made.

Although you stated in your March 14 and April 4 applications (Items 2 and 5. respectively.

on the enclosed list) that a Class III fee ($4,000) and a Class I ($400) fee for each would be forwarded under separate cover,'hese fees have not been re-ceived by us.

In your application dated April 27, 1984 (Item 7), you stated that since the change is being made at the request of the Commission in accordance with the Draft Technical Evaluation Report (issued January 12, 1982),

a license fee is not provided with it.

Hhen applications are requested by the NRC to clarify or simplify the license or Technical Specifications (TS) for the convenience of the NRC and have minor safety significance, they are exempted from the fee requirements under the provisions of Footnote 2 of 10 CFR 170.22.

Although this information was requested by the NRC, it was not requested to clarify or simplify the license or TS for NRC's convenience but rather to assure the safe handling of heavy loads at the Turkey Point Plant.

Therefore, your April 27 application is subject to the fee provisions of 10 CFR 170.22 of the March 23, 1978 regulation.

By letter dated February l. 1984, we informed your Company of the fee proce-dures regarding fire protection reviews and approvals by providing you with a copy of a letter we sent to.the Virginia Electric and Power Company dated December 5, 1983 for Surry Unit Nos.

1 and 2.

In that letter, we stated that the review and approval of alternate safe shutdown capability and any reviews which result in a denial of a request for your faci'lity are subject to fees'ursuant to 10 CFR 170.22.

The fees requested for Item 9 are consistent with the December 5 fee position for any reviews and approvals of fire protection

'equests filed prior to June 20, 1984.

Since the revised 10 CFR 170 became effective on June 20, 1984, these procedures have changed for applications fi'led on or after June 20, 1984.

For your information, a brief discussion of fees for applications for license amendments filed before and after June 20.
