Dear Hr. Fitzpatrick:
On August 29,
1996,
the
NRC completed
an inspection at your D.
C.
Cook
1 and
2
reactor facilities.
The enclosed
report presents
the results of that
inspection.
During this inspection,
inspectors
identified a violation for test controls
which failed to verify component cooling system .performance
requirements
described
in the Updated Final Safety Analysis Report
(UFSAR).
This violation
is of concern
because
your surveillance
program
was expected
to verify and
maintain system performance.
This requirement
was not recognized
by several
members of your engineering staff and was still not understood after the
integrated
performance
assessment
inspection
team identified it.
Also, during
review of the test control issue,
inspectors
noted that surveillance
flow
results,
which were less
than those described
in the
UFSAR, were established
by your staff without appropriate
safety evaluations
as specified
by 10 CFR 50.59.
As part of the violation, you are requested
to evaluate failures
by
your staff to perform required safety evaluations for changes
to plant
operation.
This should
be included in your response.
You are required to respond to this letter and should follow the instructions
specified in the enclosed
Notice when preparing your response.
In
your'esponse,
you should document the specific actions taken
and
any additional
actions
you plan to prevent recurrence,
Your response
may reference
or
include previous
docketed
correspondence, if the correspondence
adequately
addresses
the required
response.
After reviewing your response
to this
Notice, including your proposed corrective actions
and the results of future
inspections,
the
NRC will determine
whether further
NRC enforcement
action is
necessary
to ensure
compliance with NRC regulatory requirements.
In accordance
with 10 CFR 2.790 of the
NRC's "Rules of Practice,"
a copy of
this letter, its enclosures,
and your response will be placed in the
NRC
Public Document
Room.
