ENCLOSURE 1 NOTICE OF VIOLATION Arizona Public Service Company Palo Verde Nuclear Generating Station Docket Nos.:

NPF-41 NPF-74 During an NRC inspection conducted on August 25 through October 5, 1996, one violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

A.

Technical Specifications 6.8.1 requires, in part, that written procedures shall be established, implemented, and maintained covering the applicable procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.

Regulatory Guide 1.33, Revision 2, Appendix A, Section 3.0. requires procedures for the operation of auxiliary building heating and ventilation.

Procedure 40DP-9ZZ17, "Control of Doors, Hatches and Floor Plugs," Revisions 0 and 1, provided the administrative requirements for the control of barriers, which have a design function, including ventilation boundary functions.

Appendix A of this procedure provided a table which listed plant doors, the organizations which had requirements for each controlled barrier, and notes specific to types of doors.

Appendix A required that operations be contacted for compensatory measures and authorization prior to blocking open or removing a barrier identified as a heating, ventilation, and air conditioning (HVAC) barrier.

Additionally, Note 2 of Appendix A required that compensatory measures include posting an individual at the door who can close the door in the event of a safety injection actuation signal.

Contrary to the above:

On June 6, 1996, Appendix A of Procedure 40DP-9ZZ17, Revision 0, identified fuel handling building door F-202 as an HVAC barrier and workers did not contact operations prior to blocking open this door in Unit 3.

On June 26, 1996, Appendix A of Procedure 40DP-9ZZ17, Revision 0, identified auxiliary feedwater pump room water tight doors C-A01 as an HVAC barrier and workers did not contact operations prior to removing this barrier in Unit 1.

On August 2, 1996, Appendix A of Procedure 40DP-9ZZ17, Revision 1, identified that Note 2 applied to auxiliary building door A-123, and no compensatory measures were established to post an individual at the door when workers blocked the door open.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Arizona Public Service Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV, 611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response.

If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.

Where good cause is shown, consideration will be given to extending the response time.

Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.

However, if you find it necessary to include such information, you should clearly indicate the specific information that you desire not to be placed in the PDR, and provide the legal basis to support your request for withholding the information from the public.
