NOTICE OF ISSUANCE OF FACILITY OPERATING LICENSE Notice is hereby given that the U.S. Nuclear Regulatory Commission (the Commission),
has issued Facility Operating License No. NPF-41, (License) to Arizona Public Service Company, Salt River Project Agricultural Improvement and Power District, El Paso Electric Company, Southern California Edison Company, Public Service Company of New Mexico, Los Angeles Department of Water and Power, and Souther n California Public Power Authority.
This License authorizes operation of the Palo Verde Nuclear Generating Station, Unit I (facility) at reactor core power levels not in excess of 3800 megawatts thermal in accordance with the provisions of the License, the Technical Specifications and the Environmental Protection Plan.
On December 31, 1984, the Commission issued Facility Operating License No. NPF-34, which authorized operation of Palo Verde Nuclear Generating Station, Unit I at power levels not in excess of 190 megawatts thermal.
Facility Operating License No. NPF-41 supercedes Facility Operating License No. NPF-34.
Palo Verde Nuclear Generating Station, Unit I is a pressurized water reactor which utilizes a
CESSAR standard plant design and is located at the licensees site in Maricopa County, Arizona approximately 36 miles west of the city of Phoenix.

The application for the license, as
- amended, complies with the standards and requirements of the Atomic Energy Act of 1954, as, amended (the Act), and the Commission's regulations.
The issuance of this License has been authorized by the Atomic Safety and Licensing Board in its Initial Decision, dated December 30,
- 1982, and by the Commission at its meeting on May 30, 1985.
The Commission has made appropriate findings as required by the Act and the Commission's regulations in 10 CFR Chapter I, which are set forth in the License.
Prior public notice of the overall action involving the proposed issuance of an operating license was published in the FEDERAL REGISTER on July 11, 1980 (45 F.R. 46941) as clarified in a notice published July 25, 1980 (45 F.R. 49732).
The Commission has determined that the issuance of this License will not result in any environmental impacts other than those evaluated in the Final Environmental Statement since the activity authorized by the License is encompassed by the overall action evaluated in the Final Environmental Statement.

1 to Facility Operating License No.
NPF-34 for the Palo Verde Nuclear Generatinq Station, Unit 1.
The amendment consists of a change to the Technical Specifications in response to your application transmitted by letter dated April 12, 1985, and confirms the telephone notification given to Mr. D. Karner of Arizona Public Service Company on April 16, 1985, that the requested change has been granted.
The amendment revises Technical Specification 3/4.3.2, Table 3.3-5, Item 3.e, to correct the response times for the containment spray pumps.
A copy of the Safety Evaluation is also enclosed.
Notice of Issuance and Final Determination of No Significant Hazards Consideration and Opportunity for Hearing will be included in the Commission's Monthly Notice.

The Nuclear Regulatory Commission (the Commission) has found that:
A.
The application for amendment, dated April 12, 1985, by the Arizona Public Service Company (APS) on behalf of itself and the Salt River Project Agricultural Improvement and Power District, El Paso Electric
- Company, Southern California Edison Company, Public Service Company of New Mexico, Los Angeles Department of Water and
- Power, and Southern California Public Power Authority (licensees),
complies with standards and requirements of the Atomic Energy Act of 1954, as amended (the Act) and the Commission's rules and regulations set forth in 10 CFR Chapter I; B.
The facility will operate in conformity with the application, the provisions of Act, and the rules and regulations of the Commission; C.
There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations; D.
The issuance of this amendment will not be inimical to the common defense ahd security or to the health and safety of the public; and E.
The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment, and paragraph 2.C(2) of Facility Operating License No.
NPF-34 is hereby amended to read as follows:

Technical S ecifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No.
1, and the Environmental Protection Plan contained in Appendix B, are hereby incorporated in this license.
APS shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

This license amendment is effective as of April 16, 1985.

STN 50-528 Introduction By letter dated April 12, 1985, the Arizona Public Service Company (APS) on behalf of itself, the Salt River Project Agricultural Improvement and Power District, Southern California Edison
- Company, El Paso Electric Company, Public Service Company of New Mexico, Los Angeles Department of Mater and Power, and Southern California Public Power Authority (licensees),
requested an emer-gency change to the Technical Specifications (Appendix A to Facility Operating Licensee NPF-34) for the Palo Verde Nuclear Generating Station, Unit 1.
The proposed change would revise Technical Specification 3/4.3.2, Table 3.3-5, Item 3.e, to correct an error which was identified by APS on April 9, 1985.
Discussion Palo Verde Unit I is currently completing scheduled surveillance and maintenance activities in preparation for initial entry into Mode 4 (k eff ~ 0.99, 350'F 0 T cold > 210'F).
During surveillance testing of the containment spray system, APS determined that the measured response time for the containment spray pumps to reach rated speed was greater than the 17 seconds allowed by Table 3,3-5 of the Technical Specifications.
As a result, Palo Verde Unit I cannot enter Mode 4 until the measured response time for the containment spray pumps is in conformance with the Technical Specifications.
An investigation by APS revealed that the response time value presented in the Technical Specifications is significantly less than the 23 seconds used in the accident analyses presented in FSAR Section 6.2. 1.
APS proposes to change the Technical Specifications to include containment spray pump response times which are consistent with the FSAR.
APS states that the need for a correction was not obvious prior to submitting the request since the response times in question required a calculation of timing sequences to determine the total response time.
APS states that the current schedule for entering Mode 4 during the present power ascension program is April 16, 1985.
Therefore, it has requested an
. emergency change since failure to allow;the change prior to April 16, 1985 would delay the present power ascension
'program.
APS also states that the proposed change does not involve a significant hazards consideration nor an unreviewed environmental question since the change is being made solely for the purpose of correcting an error in the Technical Specifications.
Evaluation N
This proposed change falls into the category of an emergency change since failure of the NRC to take action would result in Palo Verde Unit 1 not being able to enter Mode 4 on April 16, 1985 which, in turn, would prevent the continuation of the present power ascension program until the request is granted.
As stated in the licensees'equest, the need for the proposed action was not determined until April 9, 1985.
The sta'ff has reviewed the facts concerning the request and concludes that APS has made a timely submittal, that the power ascension program cannot proceed without NRC action, and that action by the licensees could not preclude this situation.
The action requested by the licensees is to change the containment spray pump up-to-rated-speed response times listed as Item 3.e on Table 3.3-5 in the Technical Specifications.
The licensees state that the response times should be changed from 27/17 seconds to 33/23 seconds to correct an error (the first number of each set includes a
10 second delay to account for time to start the diesel generator if off-site power is lost).
The initial values do not include time for the pumps to reach rated speed after start.
The proposed revised values include this additional time and are consistent with the accident analyses presented in Section 6.2. 1 of the Palo Verde FSAR.
The staff has reviewed the information submitted by the licensees and concludes that it is acceptable to change the response times since they are consistent with the FSAR accident analyses.
Staff approval of the change was granted to APS by telephone on April 16, 1985.
-Environmental Consideration The staff has determined that the amendment does not authorize a change in effluent types or total amounts nor an increase in power level and will not result in any significant environmental impact.
Having made this determination, the staff has further concluded that the amendment involves an action which is insignificant from the standpoint of environmental impact and, pursuant to 10 CFR Part 51.5(d)(4), that an environmental impact statement, or a negative declaration and environmental impact appraisal, need not be prepared in connection with the issuance of this amendment.

Final No Siqnificant Hazards Consideration Determination The State was informed by telephone on April 15, 1985 of the staff's proposed no significant hazards consideration determination.
The State contact had no comments on the proposed determination.
The Commission has provided guidance concerning the application of the standards by providing certain examples.
The proposed change matches the example cited in 48 FR 14864; i.e., the proposed change involves a purely administrative change to the Technical Specifications in "that it provides for correction of an error in the Technical Specifications.
Based on the review of the licensees'ubmittal as described
- herein, the staff has made a final determination that the licensees'mendment request does not involve a significant hazards consideration since operation of Palo Verde Unit 1 with the requested change would not
( 1) involve a significant increase in the probability or consequences of an accident previously analyzed, (2) create the possibility of a new or different kind of accident from any accident previously analyzed, or (3) involve a significant reduction in a margin of safety.
Conclusion The staff has concluded, based on the considerations discussed above, that
( 1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed
- manner, (2) such activities will be conducted in compliance with. the Commission's regulations, and (3) the issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public.
