This refers to an inspection
conducted
by a resident
inspector for the
State of Nevada
on July 10,
1981 of a shipment of LSA radioactive waste
shipped
from your facility in Ontario,
New York to the U.S.
Ecology, Beatty,
Nevada burial site.
Areas
examined during this inspection
are described
in the report by the
State of Nevada
Resident
Inspector which is attached
to the Office of
Inspection
and Enforcement
Inspection
Report enclosed with this letter.
Within these
areas,
the inspection consisted of a review of shipping papers,
placarding,
marking and labeling, radiation measurements,
selective
contamination
surveys,
and examination of the packages
and tractor-trailer.
Based
on the results of this inspection, it appears
that
one of your
activities was not conducted
in full compliance with NRC requirements,
as
set forth in the Notice of Violation enclosed
herewith
as Appendix A.
The
violation in Appendix A has
been categorized
at the severity level described
in accordance
with the Interim Enforcement Policy published in the Federal
Re ister,
45 FR 66754 (October 7, 1980).
You are required to respond to this letter
and in preparing your response,
you should follow the instructions
in
Appendix A.
The violation in Appendix
A has already
been
the subject of enforcement
action
by the State of Nevada.
On July 16,
1981,
the State of Nevada
levied
a fine of $ 1,500
and
suspended
your burial permit for a period of
three months.
In view of the circumstances
surrounding this matter,
we
have exercised
our discretion
under the Interim Enforcement Policy and have
chosen
to issue at this time the enclosed

response
to this Notice of Violation and your proposed
corrective actions,
the
NRC will determine
whether further
NRC enforcement
action is necessary
in order to ensure
compliance with NRC regulatory
