APPENDIX A NOTICE OF VIOLATION Rochester Gas and Electric Company Rochester, New York Docket No. 50-244 License No.
DPR-18 As a result of the inspection conducted on July 10, 1981 by the State of Nevada Resident Inspector at the U.S.
Ecology, Beatty, Nevada Burial Site of the shipment of LSA radioactive waste which was shipped from the Rochester Gas and Electric Company's facility in Ontario, New York, on July 6,
- 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),
the following violation was identified:
10 CFR 71.5 prohibits delivery of licensed material to a carrier for transport unless the licensee complies with applicable regulations of the Department of Transportation in 49 CFR Parts 170-189.
49 CFR 173.392(c)(1)
- states, "Materials must be packaged in strong, tight packages so that there will be no leakage of radioactive material under conditions normally incident to transportation."
Contrary to the above, on July 6, 1981, the licensee delivered to a
carrier for transport to the U.S.
Ecology, Beatty, Nevada burial site, licensed material (LSA radioactive waste) in a container that was not a strong, tight package.
There was a hole in the side of the 55-gallon drum used as the shipping container (Package No. 1034).
This is a Severity Level III Violation.

Pursuant to the provisions of 10 CFR 2.201, Rochester Gas and Electric Company is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including:
( 1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Under the authority of Section 182 of the Atomic Energy Act of 1954, as
- amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
The responses directed by this Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
