FitzPatrick Nuclear Power Plant Notification of Expected Date of Transfer of Nuclear Unit to Exelon Generation Company, LLC, Notification of Satisfactory Documentary Evidence of Insurance, and Notification of Receipt of all Required Regulatory Approvals In accordance with Section III of the Order issued in Reference 1, we are informing the Director of the Office of Nuclear Reactor Regulation of the upcoming transfer of the James A. FitzPatrick Nuclear Power Plant Renewed Facility Operating License No. DPR-59 and the transfer of the generally licensed FitzPatrick Independent Spent Fuel Storage Installation from Entergy Nuclear FitzPatrick, LLC, as owner, and Entergy Nuclear Operations, Inc., as operator, to Exelon Generation Company, LLC to possess, use, and operate the James A. FitzPatrick Nuclear Power Plant. The closing of the transfer is expected to occur on March 31, 2017.
Additionally, as discussed in Reference 2, American Nuclear Insurers (ANI) will write nuclear liability insurance for the James A. FitzPatrick Nuclear Power Plant. A copy of Reference 2 is attached.
Any regulatory approvals required for the transfer of these licenses have been obtained.

This letter confirms that American Nuclear Insurers will write nuclear liability insurance for the James A.
Fitzpatrick Nuclear Power Plant, located in Oswego County, NY, upon transfer of the operating facility license from Entergy Nuclear Fitzpatrick, LLC and Entergy Nuclear Operations, Inc. to Exelon Generation Company, LLC.
As of the transaction close date, expected to be on March 31, 2017, ANI will amend the policy and certificates for the James A. Fitzpatrick Nuclear Power Plant as follows:
- a.
Facility Form Policy No. NF-0208: ANI will amend the named insured to reflect "Exelon Generation Company, LLC" in lieu of "Entergy Nuclear Fitzpatrick, LLC and Entergy Nuclear Operations, Inc." The operator of the facility will be Exelon Generation Company, LLC.
- b.
Master Worker Certificate No. NW-0589: ANI will amend the named insured to reflect "Exelon Generation Company, LLC" in lieu of "Entergy Nuclear Fitzpatrick, LLC and Entergy Nuclear Operations, Inc." The operator of the facility will be Exelon Generation Company, LLC.
- c.
SFP Certificate No. N-0047: ANI will amend the named insured to reflect "Exelon Generation Company, LLC" in lieu of "Entergy Nuclear Fitzpatrick, LLC and Entergy Nuclear Operations, Inc."
- d.
SFP Certificate No. N-0047: ANI will add "Exelon Generation Company, LLC" to the Bond for payment of retrospective premiums. Exelon Generation Company, LLC is assuming all past and future liabilities of Entergy Nuclear Fitzpatrick, LLC and Entergy Nuclear Operations, Inc. for the payment of retrospective premiums.
The commitment to write insurance for the James A. Fitzpatrick Nuclear Power Plant remains valid thru June 1, 2017. In the event the closing of the transaction occurs after this date, ANI will review the existing circumstances prior to reinstating our commitment to provide insurance.
