LICENSE AMENDMENT APPLICATION IN RESPONSE TO GENERIC LETTER 87-09 FOR NINE MILE POINT UNIT 2 (TAC NO. 68463)

On June 14, 1988, the Niagara Mohawk Power Corporation (NMPC) submitted an application for amendment of the Nine Mile Point Nuclear Station Unit 2 Technical Specifications (TS) in response to Generic Letter 87-09, "Sections

,3.0 and 4.0 of the Standard Technical Specification (STS) on the Applicability

, of Limiting Conditions For Operation and Surveillance Requirements."

The staff noted error s in the application and the need for supplemental information in its letter of July 18, 1988.

A response was provided by NMPC letter, dated

, September 29, 1988.

z 2 By letter dated May 19, 1989, the NRC staff requested information regarding consistency of the proposed TS with the licensing basis and an affirmation that controls had been established to limit the use of proposed exceptions to TS 3.0.4.

To date we have not received a response to our letter of May 19, 1989.

We have discussed the NMPC plans for responding to these issues on several occasions prior to our most recent discussion on October 19, 1990.

We understand that NMPC does not intend to respond to the staff's May 19, 1989, letter for the entire application as originally submitted.

Rather, NMPC intends to resubmit the application in its entirety at some future date.

Given these plans of NMPC, the NRC staff does not plan to continue review activities associated with the original application of June 14, 1988.

Your staff expressed agreement with this approach.

Accordingly, this letter completes our review activities under TAC No. 68463.
