NRC Review of Niagara Mohawk Response to Notice of Violation, Enforcement Action 89-70 Gentlemen:

Your letter dated November 16, 1989 responded to Notice of Violation, Enforce-ment Action (EA) 89-70, transmitted to you via letter dated September 22, 1989.

The enforcement included nine violations, some of which had multiple examples.

In your November 16 response, you disagreed with violations II.B.5, II.C.

and II.D.1.

and admitted to the remaining violations of regulatory requirements set forth in the Notice of Violation, EA 89-70.

After review of your response and further discussions with the technical staff, we agree with your position regarding violations II.B.5, II.C and II.D. 1 and hereby rescind the same.

Specifically, these violations are concerned with the acceptability, corrective action, and reporting to NRC, respectively, regarding Technical Specifications for reactor operation with an inoperable loop in the core spray system.

These issues had been raised during the NRC Safety System Functional Inspection (SSFI).

Our additional consideration of these

issues, including a review of the NRC safety evaluation report (SER) on a

1975 Tech-nical Specifications amendment, determined that Niagara Mohawk was not in violation of the cited requirements.

It is important to reemphasize that it remains the license holder's responsi-bilityy to ensure the facility' design basis and safety analyses are properly reflected in proposed Technical Specification amendments.

Regarding the limiting condition for operation (LCO) with an inoperable loop of core

spray, it was Niagara Mohawk's responsibility to be aware of all of the safety analysis assumptions and to ensure their proper implementation.

Accordingly, it was, and-;remains, incumbent upon Niagara Mohawk to ensure the technical accuracy and.:"c'ompleteness of facility changes and associated operating license amendments.
