APPENDIX A NOTICE OF VIOLATION Niagara Mohawk Power Corporation Nine Mile Point Unit 2 Docket No.

50-410 License No.

NPF-69 During an NRC inspection conducted on 4/4/89 through 5/12/89, and in accordance with NRC Enforcement Policy, 10 CFR 2, Appendix C, the following violations were identified:

A.

Technical Specification 3.3. 1, Reactor Protection System Instrumentation, states that with a number of operable channels of main steam line radiation monitors less than the minimum for that Trip System, the inoperable channels and that Trip System shall be placed in the tripped condition within one hour.

Contrary to the above, for over one hour on April 6,

1989, both Division 1

main steam line radiation.monitors (channels A and C) were inoperable and their respective Trip System was not tripped.

This is a Severity Level IV Violation.

10 CFR 50.59 states that a change to the facility as described in the Final Safety Analysis Report (FSAR) may be made provided a safety evaluation is performed to determine that the change does not involve an unreviewed safety question (URSQ).

FSAR section 6.3.2.2 '

states to ensure leakage from the Emergency Core Cooling Systems (ECCS) discharge line is replaced and the lines are always kept filled, a water leg pump is provided in each of the three ECCS divisions.

The power supply to these pumps is classified as essential when the main ECCS pumps are deactivated.

In addition, Procedure N2-OP-33 requires the High Pressure Core Spray (HPCS) keep fill pump to be operating while the HPCS system is lined up in standby ready for automatic initiation.

Contrary to the above, the licensee made a change to the facility as described in the FSAR by removing from service the HPCS keep fill pump and thereby terminating continuous filling of the discharge piping.

This action was taken on May 11, 1989 without first performing a safety evalua-tion to determine-that this'hange did not involve an URSQ.

This is a Severity Level IV Violations (Supplement I)

Pursuant to the provisions of 10 CFR 2.201, Niagara Mohawk Power Company is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including:

( 1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending this response time.
