APPENDIX A NOTICE OF VIOLATION Niagara Mohawk Power Corporation Nine Mile Point Unit 1 and 2

~ DRP-63/NPF-69 As a result of the inspection conducted on April 1, 1988 to May 5,

1988, and in accordance with NRC Enforcement Policy (10 CFR Part 2, Appendix C) the following violations were identified:

Contrary to the above, the actions taken to correct the cause of the failure to perform firewatch patrols on February 22 and June 18, 1987 (at Unit 2) and on October 27, 1987 (at Unit 1) were ineffective because they did not preclude a missed firewatch patrol at Unit 1 on April 27, 1988.

This is a Severity Level IV Violation (Supplement I).

Nine Mile Point Unit 2 Technical Specification 4.0. 1 states that Surveillance Requirements shall be met during the operational condition specified or when otherwise stated in an individual Surveillance Requirement.

Technical Specification 4.6. 1.2.d states that Type B tests shall be conducted on primary containment penetrations at intervals no greater than 24 months.

Contrary to the above, on April 6, 1988, primary containment penetration Z-74 was not tested within 24 months.

4. 11.2. 1.2 and Table 4. 11.2-1 require that a sample of the primary containment be taken and analyzed prior to commencing a purge of the containment.

10 CFR Part 50, Appendix B, Criterion XVI requires that measures shall be established to identify the cause for and to promptly correct conditions adverse to quality to preclude repetition.

Pursuant to the provisions of 10 CFR 2.201, the Niagara Mohawk Power Corporation is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending this response time.
