Utica, New York 13501 Dear Congressman Boehlert:

This is in response to your letter to Mr. Carlton Kammerer, Director, Office of Congressional Affairs, Nuclear Regulatory Commission, concerning the September 15, 1986, letter you received from your constituent, Ms. Roberta Ziegler (Enclosure 1).

In response to Ms. Ziegler's questions, please advise her that the Nuclear Regulatory Commission (NRC) is responsible for reviewing applications for licenses for nuclear power plants and for overseeing the safety and operation of these plants.

Regarding Ms. Ziegler's concern that this agency be above "the influence of big money", the NRC is an independent agency which makes its determination based on the requirements of Federal laws and regulations.

Ms. Ziegler also requested a map or a list of all nuclear power sites.

Enclosed (Enclosure

2) is a copy of NUREG-0871, Vol. 4, No. 1, "Summary Information Report".

This document contains a list of commercial nuclear power reactors and their locations.

In addition to her specific questions, Ms. Ziegler expressed concern about the safe operation of the Nine Mile Point Nuclear Station, Unit 2 (Nine Mile Point

2) near
Oswego, New York.

The Atomic Energy Commission (AEC) (now the Nuclear Regulatory Commission (NRC)) received an application for a construction permit on March 8, 1972.

Following a public hearing and a review by the AEC staff of the application submitted, a construction permit was issued for Nine Mile Point 2 on June 24, 1974.

On January 31, 1983, the NRC received the application for an operating license for 'ince that time, the NRC has extensively reviewed the design of Nine Mile Point 2, and has inspected the facility. In addition, a full time resident inspector was assigned to the site.

Through this review process, the NRC is able to establish that there is reasonable assurance that the facility can be operated by the applicant without endangering the health and safety of the public before issuing the applicant a license to operate the facility.

Ms. Ziegler also expressed a concern about faulty safety valves at Nine Mile Point 2.

In the last few months two problems were identified concerning the-main steam isolation valves (MSIVs).

As their name suggests, these valves are used to isolate the four main steam lines in the event isolation is required.

The NRC staff is presently reviewing the problems encountered with these valves and the remedies proposed by the utility.

Before any exemptions to NRC regula-

tions, as requested by the applicant, could be granted on these valves, the staff must determine that the exemption would not jeopardize the health and safety of the public. The results of the NRC staff's review of these valves will be available to the public through the NRC document rooms discussed above.
