EMERGENCY LICENSE CHANGE EXTENDED OPERATION WITH IDENTIFIED DESIGN DEFICIENCIES IN THE PROCESS PIPE Re:

Nine. Mile Point Nuclear Station, Unit No.

1 By application dated January 23,

1986, as supplemented and clarified by letter dated January 24,
1986, you requested an emergency change to the Facility Operating License which would permit operation during the remainder of Cycle 8 with the process pipe penetration design not in complete conformance with the design criteria as specified in the FSAR.

We have reviewed your evaluation and justification provided in your submittal including your administratively imposed compensatory

measures, and ind them acceptable.

This letter will confirm the verbal granting of a temporary waiver of compliance to permit operation with the existing process pipe penetrations.

This waiver of compliance will be in effect for 2 days while we complete the processing of your amendment request.
