~C An NRC Inspection and Investigation on October 8-10, 20-31, November 1, and 18, 1980 revealed that certain actions required by an NRC ORDER TO SHOW CAUSE, issued to Niagara Mohawk Power Corporation on January 2, 1980, relating to NUREG-0578, TMI-2 Lessons Learned Task Force Status Report and Short Term Recommendations, wer e not implemented.
Specifically, "Category A" Item 2. 1. 8. b requirements were not implemented by January 31, 1980.
Moreover, this failure to implement is significantly aggravated hy your company's sworn assurance that the requirement had been implemented.
In a sworn statement dated January 22, 1980, which the NRC Staff relied upon in permitting continued. operation of Unit 1 beyond January 31,
- 1980, Mr. Bartlett stated that the actions on "Category A" Item 2. 1.8.b had been completed on December 31, 1979.
As described in Appendix A, this is a material false statement.
The results of our investigation of this matter show that the (then) Site
.Superintendent was aware that the required actions had not been completed when he concurred in the information contained. in the January 22, 1980 sworn statement.
These circumstances raise serious questions about your management control system.
Accordingly, we propose to impose a civil penalty in the amount of $225,000 for the items of noncompliance set forth in the Notice of Violation.

You are required to respond to these Notices and in preparing your response, you should followMhe instructions in Appendices A and B.
