r By communications with both the NRC Office of Inspection and Enforcement and with Niagara Hohawk licensing personnel it has come to the staff's attention that you plan to modify, without NRC review and approval, two Nine Hile Point Unit 1 s'afety related systems.

The proposed'odifi-cations affect:

(1) the Core Spr ay System by the installation of-bypass lines around HOV's IV 40.01, 40.09, 40.10 and 40.11 and (2) the Reactor Protection System by the installation of the'Analog Transmitter/Trip Unit System (ATTUS).

At this time you are advised that the aforementioned activities are being initiated at your own financial, risk.

Installation should'ot commence unless these activities are fully in compliance with the rules and regu-lations of the Commission, particularly 10 CFR ~0.59 and the Nine Hile Point Unit 1 Operating License.

In order that we may be kept fully informed of the exact nature of 'these deter1ninations, we request that you send us copies of your written safety evaluations which provide the basis, for, your conclusion that such activities are permissible without prior NRC authorization.

These safety evaluations should be forwarded to us in advance of your commencement of any installation activity.

, should include, but not be limited to, the following items:

(1) piping

-stress

analyses, (2) pipe break/pipe i>hip analysis, (3)'ystem flow balance with bypass both open and Hosed, (4) 'water hammer analysis, (5) revised drawings and valve line-up lists, (6) revised Technical Specifications, (7)

ASHE B5PV Code requirements, (8) most recent re'suits for tests conducted in accordance with Technical Specification 4.1.4, and (9) results of the Core Spray Sparger leakage test.

(1) interface information as delineated in Section 5.4 of NEDO-21617-1 dated January
