Your application notarized June 7, 1972, as transmitted by letter dated June 15, 1972, requested amendment to Provisional Operating License No. DPR-17 to designate the nuclear facility licensed thereunder as Unit No. 1 of the Nine Mile Point Nuclear Station. Our letter to you dated. December 5, 1972, stated that this action would be combined with our next amendment issuance; however, we have amended the license at this 'time since the only outstanding license.,action pending with the Commission is the conversion of the provisional operating license to a "

'full-term license which is not scheduled to be completed until approx-imately the end of 1974.

Consequently, Amendment No. 3 to Provisional Operating License No.

DPR-17 is enclosed designating the facility as Unit No. 1. As re-quired by Part 2 of the Commission's regulations, a notice of issuance (copy enclosed) has been filed with the Office of the Federal Register for publication.

NIAGARA ESHAWK POWER CORPORATION DOCKET NO 50-220 AHENDHMT TO PROVISIONAL OPERATING LICENSE Amendment No. 3 License Mo. DPR-17 The Atomic Energy Commission ("the Commission" ) has found that:

A. The application'y the Niagara Hohawk Power Corporation notarized June 7, 1972, complies with the requirements of. the Atond.c Energy Act of. 1954, as amended, and the Commission's regulations set

.forth in 10 CFR Chapter I;

3. The issuance of this amendment for designation of a unit number for the nuclear facility under Commission Provisional Opi3rating .

License No. DPR-17 will not be inimical to the common defense and security or to the health and safety of the public, and C. Prior public notice of proposed issuance of this 1icense amendment is-not required since the amendment does not involve a significant hazards consideration.

1 Accordingly, Provisional Operating License No. DPR-3.7 issued to the Niagara Mohawk Power Corporation is hereby amended by replacing the facility name "Nine Mfle Point Nuclear Station" with "Nine Nile Point Nuclear Station Unit No. 1" wherever it appears in .the license and the Technical'pecifi-cations appended thereto and subsequent amendments and changes thereto.

All other portions of the license remain unchanged.

This amendment is effective as of its date of issuance.

k UNITED STATES ATONZC 'ENERGY 'COMMXSSION DOCKET NO. 50-220 NIAGARA MOHAK< POWER CORPORATION NOTICE OF ISSUANCE OP FACILITY LICENSE ALKHDMENT Notice is hereby given that the Atomic Energy Commission ("the Commission" ) has issued Amendment No. 3 to Provisional Operating License No. DPR-17 designating the nuclear facility licensed thereunder as Unit No. 1 of the Nine HfLe Point Nuclear Station. The amendment is effective as of its date of issuance.

The Niagara Mohawk Power Corporation of Syracuse, Hew York, is the holder of Provisional Operating License No. DPR-17 issued by the Commission on August 22, 1969, for possession, use and"operation of a boiling water type nuclear power reactor facility on its site in Scribe, Oswego County, New York,. at power levels up to 1850 megawatts (thermal).

By application notarized June 7, 1972~ as transmitted by letter 4

dated June 15, 19723 the Niagara 5fohawk Power Corporation requested that Provisional Operating License No. DPR-17 be amended to designate the nuclear power reactor facility licensed thereunder as Unit No. 1 of the Nine Nile Point Nuclear Station to avoid confusion, since the Corporation has filed an application with the Commission for construction of a second. facility on its site in Scriba, New York.

The Commission's regulatory staff has found that the application complies with the requirements of the Atomic Energy Act of 1954, as amended, and the Commission's regulations published in 10 CFR Chapter I, and that the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public. Since operation of the facility in the mannex'reviously reviewed and approved by the. Commission is not altered'by the issuance of this amendment, the Commission's regulatory staff also has concluded that this action does not involve significant hazards considerations; consequently, prior public notice of proposed issuance of the amendment is not required.

A copy of Niagara Mohawk Power Corporation's application of June 7, 1972, and a copy of Amendment No. 3 to License No. DPR-17 are available for public inspection at the Commission's Public Document Room at 3.717 H f
