ACKNOWLEDGEMENT OF RECEIPT OF REVISION 1 TO NEI 15-03 CONCERNING NONCONSERVATIVE TECHNICAL SPECIFICATIONS

Dear Mr. Montgomery:

Since 2014, the U.S. Nuclear Regulatory Commission (NRC) and industry, including the Nuclear Energy Institute (NEI), have held several public meetings to discuss actions that may be used by nuclear reactor licensees to address technical specifications (TSs) that are determined to be insufficient to assure plant safety. On May 11, 2015 (Agencywide Documents Access and Management System (ADAMS) Package Accession No. ML15147A653), NEI submitted an industry guidance document, NEI 15-03, Revision 0, Licensee Actions to Address Nonconservative Technical Specifications, dated April 2015, for review and endorsement by the NRC staff. On July 11, 2016, a public meeting was held on the submittal to discuss several topics (ADAMS Accession No. ML16194A262). On October 31, 2016, NEI submitted Revision 1 to NEI 15-03 (ADAMS Package Accession No. ML16309A006), which was intended to address some of the issues discussed in the public meeting. In that submittal, NEI requested NRC staff review and approval of NEI 15-03, Revision 1, for use by industry.

Currently, NEI 15-03, Revision 1, is under review to determine if the identified concerns have been addressed appropriately, and whether the proposed guidance is suitable for the NRC to approve for use by industry. The NRC staff plans to provide the results of its review this summer.
