PILGRIM NUCLEAR POWER STATION - SECURITY BASELINE INSPECTION REPORT 05000293/2016403 AND EXERCISE OF ENFORCEMENT DISCRETION

Dear Mr. Dent:

On December 1, 2016, the U.S. Nuclear Regulatory Commission (NRC) completed a security inspection at your Pilgrim Nuclear Power Station and discussed the results of this inspection with you and other members of your staff. The results of this inspection are documented in the enclosed report.

NRC inspectors documented six findings of very low security significance (Green) in this report.

Each of these findings involved violations of NRC requirements and were determined to be of very low security significance (Green). Further, inspectors documented three licensee-identified violations which were determined to be of very low security significance in this report. The deficiencies were promptly corrected or compensated for, and the plant was in compliance with applicable physical protection and security requirements within the scope of this inspection before the inspectors left site. The NRC is treating all of these violations as non-cited violations consistent with Section 2.3.2.a of the Enforcement Policy. If you contest any of these violations or their significance, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, DC 20555-0001; with copies to the Regional Administrator, Region I; the Director, Office of Enforcement; the Director, Office of Nuclear Security and Incident Response; and the NRC resident inspector at the Pilgrim Nuclear Power Station.

Enclosure contains Sensitive Unclassified Non-Safeguards Information. When separated from enclosure, the transmittal document is decontrolled. Five cross-cutting aspects, as described in NRC Inspection Manual Chapter 0310, Aspects Within Cross-Cutting Areas, were assigned to the findings in the area of Human Performance (Avoid Complacency, Resources, Challenge the Unknown, Conservative Bias, and Documentation). Specifically in these examples, Entergy did not effectively implement error reduction tools, maintain equipment availability, challenge unusual conditions, use prudent decision making, and maintain complete and accurate documentation.

If you disagree with the cross-cutting aspect assignments in this report, you should provide a response within 30 days of the date of this inspection report, with the basis for your disagreement, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001, with copies to the Regional Administrator, Region I; and the NRC resident inspector at the Pilgrim Nuclear Power Station.

Although a violation of Title 10 of the Code of Federal Regulations (10 CFR) Part 37 with respect to Category 2 quantities of radioactive material stored in robust structures was identified and the issue was discussed during the exit meeting, Entergy met all the criteria in NRC Enforcement Guidance Memorandum 14-001 for the use of enforcement discretion; therefore, the NRC is exercising enforcement discretion (EA-16-190) and will not issue any enforcement action for this violation. Additional details are contained in the non-public enclosure.

However, the enclosed report contains Security-Related Information, so the enclosed report will not be made publically available in accordance with 10 CFR 2.390(d)(1). If you choose to provide a response that contains Security-Related Information, please mark your entire response Security-Related Information-Withhold from public disclosure under 10 CFR 2.390 in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). The NRC is waiving the affidavit requirements for your response in accordance with 10 CFR 2.390(b)(1)(ii).
