VIOLATION)

This refers to the inspection

conducted

by M. Tschiltz,

and the inspectors

identified in the enclosed

report, of this office on September

1 through

October

15,

1994.

The inspection

included

a review of activities authorized

for your Diablo Canyon Nuclear

Power Plant,

Units

1 and 2, facility.

At the

conclusion of the inspection,

the findings were discussed

with members of your

staff identified in the enclosed report.

Areas

examined during the inspection

are identified in the report.

Within

these

areas,

the inspection consisted of selective

examinations of procedures

and representative

records,

interviews with personnel,

and observation of

activities in progress.

The purpose of the inspection

was to determine

whether activities authorized

by the license

were conducted

safely

and in

accordance

with NRC requirements.

Based

on the results of this inspection,

certain licensed activities appeared

to be in violation of NRC requirements,

as specified in the enclosed

Notice of

Violation (Notice).

The violation involved

a power panel

switch which was not

in the required position

and is of concern

because it was identified by the

NRC and involved alignment of vital power to

a safety-related

system.

Two violations are not being cited.

The first violahion involving the

centrifugal

charging

pumps is not being cited because

the criteria in

Section VII.B.2 of Appendix

C to

10 CFR Part 2 of the NRC's "Rules of

Practice,"

were satisfied,

The second violation, involving improper alignment

of the residual

heat

removal

system during surveillance testing,

is not being

cited because

the criteria in Section VII.B.1 of Appendix

C to

10 CFR Part 2

of NRC's "Rules of Practice"

were satisfied.

The first involved actions

which

resulted

in both centrifugal

charging

pumps

being

made inoperable

in Mode

4

when Technical

Specifications

required that

a minimum of one

pump remain

operational.

The second

involved the failure to properly align the residual

heat

removal

system according to procedure

during

pump testing.

Although

10 CFR 2.201 provides for a written statement

of explanation to this

office within 20 days of your receipt of this Notice,

we note that this

violation had

been corrected

and those actions,

including your root cause

analysis,

were reviewed

and found acceptable

during this inspection.

Therefore,

no response

with respect

to this matter is required.

In accordance

with 10 CFR 2.790 of the

NRC's "Rules of Practice,"

a copy of

this letter

and its enclosures will be placed in the

NRC Public Document

Room.
