NRC INSPECTION REPORT NO. 50-275/99-03; 50-323/99-03 AND EXERCISE

OF ENFORCEMENT DISCRETION

Dear Mr. Rueger:

This refers to the inspection conducted on January 24 through March 6,1999, at the Diablo

Canyon Nuclear Power Plant, Units 1 and 2, facility. The enclosed report presents the results

of this inspection.

However,

During the 6-week period covered by this inspection period, your conduct of activities at the

Diablo Canyon Nuclear Power Plant facilitywas generally characterized by safety-conscious

operations, sound engineering and maintenance practices, and good radiation protection

support.

However, four violations of NRC requirements varying in level of significance were

identified.

The most significant violation, which occurred in early 1998, involved the failure to perform an

adequate safety evaluation in accordance with 10 CFR 50.59 for an issue that involved an

unreviewed safety question

(EA 98-517).

Specifically, the issue involved eliminating Diablo

Canyon's dependence

on the Morro Bay Power Plant for reliable offsite power. After

consultation with the Director, Office of Enforcement, the NRC is exercising enforcement

discretion in accordance

with VII.B.6 of the Enforcement Policy and refraining from issuing a

Notice of Violation. Discretion is appropriate because of: (1) confusion surrounding the

determination of whether the change constituted an unreviewed safety question, (2) the

similarity to other issues previously cited for which corrective actions have been taken and are

sufficiently broad to address this violation (EA 98-364), and (3) the apparent improvement in

grid reliabilitythat resulted from the change.

The three additional violations of NRC requirements that occurred are being treated as

noncited violations, consistent with Appendix C of the Enforcement Policy. The circumstances

associated

with each of the noncited violations are described in the enclosed inspection report.

If you contest any of these violations or the severity level of the noncited violations, you should

provide a response within 30 days of the date of this inspection report, with the basis for your

denial, to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington

DC 20555-0001, with copies to the Regional Administrator, Region IV, and the Director, Office

of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.

As we reviewed the aggregate performance during the recently completed Unit 1 refueling

outage described in this report, it was noted that your staff faced a number of challenges such

as the sudden decrease

in reactor coolant system level, the inadvertent loss of spent fuel pool

cooling, and the higher than expected radiological exposure.

Based upon both number and

potential consequences

of these challenges, numerous questions have arisen concerning the

outage control practices at Diablo Canyon.

Therefore, we would like to schedule a meeting with

your management team to discuss your overall performance during Refueling Outage 1R9.

This meeting would seem to be most appropriately conducted following the completion of your

outage self-critique. My staff willcontact your licensing organization to make the appropriate

arrangements.

In accordance with 10 CFR 2.790 of the NRC's "Rules. of Practice," a copy of this letter and

its'nclosure

willbe placed in the NRC Public Document Room (PDR).
