A copy of your August 8, 1983 letter, which transmitted a proposed change to Chapter 17 of the Diablo Canyon Power Plant Final Safety Analysis Report for NRC review and approval,.has been forwarded to our office.
This document was sent to the USNRC s Region V for review and approval.
Fees pursuant to 10 CFR 170.22 were not remitted with the request.
Based on information provided by the Region Y review staff, it has been deter-mined that a Class III fee ($4,000) is appropriate for the August 8 request since the review will be more than administrative or pro forma in nature.
It is our understanding that this Chapter pertains to the guality Assurance Program for the Diablo Canyon Plant and will not require unit-specific reviews and/or amendment to the license for Diablo 1 or to the Diablo 2 construction permit.
Consequently, we, have concluded that the Class I duplicate unit fee of $400 for Unit No. 2 should not be assessed.
It is requested that your Com-pany remit the sum of $4,000 to our office for your August 8 request.
If'he Region V staff's fina'1 review of your request reveals that this fee is not correct, you will be notified and any necessary adjustments will be made.
