NOTIFICATION The U.S. Nuclear Regulatory Commission (NRC) staff (Staff) is filing this notification to inform all participants that the Staff has provided the Commission with a Notification of Significant Licensing Action (NSLA) stating that the Staff intends to issue an order approving the indirect transfer of the 90 percent interest of Susquehanna Nuclear, LLC in the renewed facility operating licenses for the Susquehanna Steam Electric Station (SSES), Units 1 and 2, as well as the general license for the SSES Independent Spent Fuel Storage Installation, from the current parent holder, Talen Energy Corporation, to Riverstone Holdings LLC, on or about November 30, 2016. The NSLA is attached.

PROPOSED ISSUANCE OF ORDER APPROVING THE INDIRECT TRANSFER OF A LICENSE FOR WHICH A REQUEST FOR ACCESS TO SUNSI HAD BEEN SUBMITTED This is to inform the Commission that the U.S. Nuclear Regulatory Commission (NRC) staff intends to issue an order approving the indirect transfer of the 90 percent interest of Susquehanna Nuclear, LLC (Susquehanna Nuclear) in the renewed facility operating licenses for the Susquehanna Steam Electric Station (SSES), Units 1 and 2, as well as the general license for the SSES Independent Spent Fuel Storage Installation, from the current parent holder, Talen Energy Corporation, to Riverstone Holdings LLC (Riverstone), on or about November 30, 2016. On October 20, 2016, the NRC staff denied this access request. 4 On October 24, 2016, Mr. Monatesti appealed the NRC staffs denial of his access request. 5 On October 25, 2016, the Secretary of the NRC referred this appeal to the Chief Administrative Judge of the Atomic Safety and Licensing Board Panel. 6 On October 26, 2016, the Chief Administrative Judge of the Atomic Safety and Licensing Board Panel, pursuant to delegation by the Commission, established an Atomic Safety and Licensing Board (Board) to preside over Mr. Monatestis appeal of the NRC staffs denial of his access request. 7 On November 21, 2016, the Board affirmed the NRC staffs denial. 8 The Board also stated that, to the extent that Mr. Monatestis October 11, 2016, filing included a hearing request, it remains pending before the Commission 9 and that Mr. Monatesti may appeal the Boards decision to the Commission within 25 days. 10 4 Letter from NRC to Sabatini Monatesti, Request for Access to Sensitive Unclassified Non-Safeguards Information Related to the Application for Indirect Transfer of the Susquehanna Steam Electric Station (October 20, 2016) (ADAMS Accession No. ML16294A385).
