OF JULY 12, 2016, PUBLIC MEETING WITH EXELON TO DISCUSS DECOMMISSIONING TRANSITION PLANS FOR CLINTON, QUAD CITIES, AND OYSTER CREEK (CAC NOS. MF8097, MF8099, MF8100, AND MF8098)

On July 12, 2016, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Exelon Generation Company, LLC, the licensee, at NRC Headquarters, Three White Flint, 11601 Landsdown St. Rockville, Maryland. The purpose of the meeting was to afford Exelon, the licensee for Clinton Power Station, Unit 1 (Clinton),

Quad Cities Nuclear Power Station, Units 1 and 2 (Quad Cities), and Oyster Creek Nuclear Generating Station, Unit 1 (Oyster Creek), an opportunity to discuss pending and present licensing activities associated with the continued operation of these plants and future decommissioning plans and schedules. The meeting notice and agenda, dated June 23, 2016, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML16183A199. A list of attendees is provided as Enclosure 1.

On June 20, the licensee submitted letters to the NRC certifying the permanent cessation of operations for Clinton by June 1, 2017, and for Quad Cities, by June 1, 2018 (ADAMS Accession Nos. ML16172A137 and ML16172A151, respectively). By letter dated January 7, 2011, the licensee certified its contingent determination to permanently cease operations at Oyster Creek no later than December 31, 2019 (ADMAS Accession No. ML110070507).

No regulatory decisions were made at this meeting. After opening remarks, the NRC staff gave a high level review of the regulatory framework for the decommissioning transition process. An overview of the decommissioning process is available in NUREG/BR-0521, "Decommissioning Nuclear Power Plants" (ADAMS Accession No. ML 1421 OA472), and Regulatory Guide 1.184, "Decommissioning of Nuclear Power Reactors, Revision 1," (ADAMS Accession No. ML13144A840).

The licensee presented their integrated licensing action submittal plan, which is available in ADAMS at Accession No. ML16189A433. This presentation summarized the accelerated schedule for licensing actions in support of Clinton's announced cessation of operation by June 1, 2017. The licensee stated that if other sites in the Exelon fleet enter decommissioning transition, they will factor those sites into the integrated schedule. Exelon's overall goal is to provide a safe and efficient transition from an operating site to a permanently shutdown site.

The licensee discussed two major milestones for each site in decommissioning transition. The first milestone is to permanently shutdown and defuel the site and second milestone is the end of the Zirc-Fire period, which is estimated to be 14 to 18 months after shutdown. The requested approval dates for the submittals are 60 days in advance of the milestone date to enable efficient implementation of the Decommissioning Trust Funds, facilitate change management for staff transitions, and provide more certainty for external stakeholders such as the state and local governments.

The NRC staff noted for clarity that the exemption request from certain Emergency Preparedness requirements (submittal LS-14) and the license amendment request for Permanently Defueled Emergency Plan (submittal LS-15) are related since the amendment would implement the exemption if it is approved by the NRC staff. The licensee acknowledged that these two submittals are related and could be submitted, at or near the same time, even though the NRC review and approval of these actions are separate.

The licensee stated that they are continuing to evaluate the impact of decommissioning plans on existing and expected licensing submittals which are not directly related to decommissioning transitioning. At this time, the licensee does not anticipate withdrawing or delaying any current licensing actions. The licensee confirmed they will maintain close communication with the NRC licensing project managers if a decision to delay, defer or eliminate planned submittals is made.

The licensee said that they plan to request relaxation to the Fukushima Order for Hardened Containment Ventilation Systems (EA-13-109) for Quad Cities, Unit 1. The NRC staff from the Japans Lessons Learned Division asked if there are plans to submit a relaxation request for Quad Cities, Unit 1, for the Mitigating Strategies Order (EA-12-049). The licensee said they plan to request relaxation to both applicable Fukushima Orders to discontinue submitting 6 month update reports and agreed to follow up with more detailed submittal plans for these requests.

To facilitate a timely review, the NRC staff emphasized the need for frequent communication of schedule plans, holding pre-submittal public meetings for significant licensing actions, submitting high quality applications, and timely responses to requests for additional information.

Numerous members of the public and external stakeholders were in attendance by phone and one in person. Exelon addressed a question regarding the use of precedence from other sites which have recently gone through decommissioning transition. Exelon said it would use the precedence and industry lessons learned to inform their submittal plans and ensure that high quality licensing actions are submitted to support their proposed schedule. The NRC staff addressed other questions from the public regarding transportation of radioactive materials and identified inspection impacts.
