SHEARON HARRIS NUCLEAR POWER PLANT, UNIT 1, ACCEPTANCE OF LICENSE AMENDMENT REQUEST TO MODIFY DIESEL FUEL OIL TESTING SURVEILLANCE REQUIREMENTS (MF7775)

Dear Mr. Benjamin C. Waldrep:

By letter dated May 26, 2016 (Agencywide Document Access and Management System (ADAMS) Accession No. ML16151A001), Duke Energy Progress, Inc. (Duke Energy), submitted a license amendment request, in accordance with 10 CFR 50.90, to Technical Specifications (TS) Section 6.8, Procedures and Programs, and Section 3.8, Electrical Power Systems, at the Shearon Harris Nuclear Plant (HNP), Unit 1. Duke Energy is requesting to add a new Administrative Control TS to establish, implement, and maintain a Diesel Fuel Oil Testing Program for the testing of new and stored fuel oil. Duke Energy is also requesting to modify its TS by moving the surveillance requirement to perform a 10-year sediment cleaning of the fuel oil storage tank to a licensee-controlled document. Duke Energy is also requesting an exception to Regulatory Guide 1.137, Revision 1, to allow for the ability to perform new fuel oil sampling offsite prior to its addition to the storage tanks.

The purpose of this email is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review.
