CONFIRMATION OF ACTION LETTER - OCONEE UNITS 1, 2, AND 3 Gentlemen:
This letter refers to the telephone conference between Mr. J. Johnson and yourself on May 5, 1997, concerning actions you will take as a result of the unisolable Unit 2 reactor coolant system leak identified on April 22, 1997, emanating from a cracked weld in the transition piece between the High Pressure Injection (HPI) line and the 2A1 reactor coolant loop. Unit 2 is in cold shutdown undergoing failure investigation/repairs; Unit 3 has also recently been shut down due to the potential for a HPI line failure similar to that experienced in Unit 2; and a Justification of Continued Operation (JCO) for Unit 1 has been submitted for NRC review. We understand that Duke Power Company is actively investigating the root cause of the Unit 2 HPI weld failure and evaluating the actions.that have been or will be taken in response.
It is also our understanding that you have or will take the following actions:
(1) Determine the cause of the Unit 2 cracked HPI weld, including the failure of your programs (e.g., Generic Letter 85-20 and Bulletin 88-08 augmented inspection) to preclude such an event.
Evaluate the findings and implement appropriate corrective actions to prevent recurrence including a response to the NRC questions made available to you on May 2, 1997.
(2) Determine the cause of the Unit 3 HPI system degradation which delayed entry into cold shutdown on May 3, 1997. Evaluate the findings and implement appropriate corrective actions. Verify Unit 1 letdown storage tank level instrument accuracy weekly, until root cause and. corrective actions are implemented.
(3) Implement as a compensatory measure, the enhanced leakage detection and make up flow guidelines for Unit 1 set forth in your letter of May 3, 1997.

(4) Meet with the NRC to discuss the results of (1) and (2)
- above, including any impact on the continued safe operation of Unit 1.
Obtain concurrence from the Regional Administrator prior to.reactor criticality for Units 2 or 3.
Pursuant to Section 182, of the Atomic Energy Act, 42 U.S.C. 2232, you are required to:
Notify me immediately if your understanding differs from that set forth above.
Notify me if for any reason you cannot complete the actions within the specified schedule and advise me in writing of your modified schedule in advance of the change.
Notify me in writing when you have completed the actions addressed in the Confirmation of Action Letter.
Issuance of this Confirmation of Action Letter does not preclude issuance of an order formalizing the above commitments or requiring other actions on your part; nor does it preclude the NRC from taking enforcement action for violations of NRC requirements that may have prompted the issuance of this letter. In addition, failure to take the actions addressed in this Confirmation of Action Letter may result in enforcement action.
The responses directed by this letter are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.
