SUBJECT:

TEMPORARY WAIVER OF COMPLIANCE - OCONEE NUCLEAR STATION, UNITS 2 AND 3 By letter dated September 29, 1989, you requested an emergency Technical Specification (TS) change which would add a note to TS Table 4.4-1, specifying when integrated (Type A) and local (Type C) leak rate testing becomes applicable for containment penetration 53.

The TS change also modifies Table 4.4-1 to reflect the requirement to perform Type C testing of this penetration. You subsequently informed us in a letter dated October 4, 1989, that maintenance had been performed on boundary valves for containment penetration 39 without the performance of required post-maintenance leak rate testing for Oconee Units 2 and 3. Your letter requested that the proposed TS change be revised to require the same leak rate testing for penetration 39 as for penetration 53.

The current TS requires isolation of penetration 39 in order to continue plant operation. However, intermittent use of this penetration is required during plant operation to charge the B core flood tank with nitrogen.

This emergency TS change is required to continue operation of Units 2 and 3.

We have reviewed your evaluation and the justification, including compensatory actions, provided in your submittal and find them acceptable. This letter confirms the verbal granting of a temporary waiver of compliance from the requirement of TS 3.6.3c to allow intermittent use of penetration 39 to charge the 8 core flood tank. This temporary waiver of compliance will be in effect while the staff completes the processing of your emergency change request. Proposed TS pages 4.4-9, 4.4-10 and 4.4-13 are enclosed for your information.

12A one-time extension from the local leak test and corresponding exemption from Sections III.D.2 and II.D.3 of Appendix J to 10 CFR Part 50 is granted such that it be performed during the 1983 Unit 1 refueling outage, provided that such outage begins no later than July 16, 1983.

NOTE 13 The requirements to perform a Type A test in accordance with Notes 1 and 3 of Table 4.4-1, will dommence during the end of cycle 12 refueling outage on Unit 1, and during the end of cycle 11 refueling outages on Units 2 and 3. For the Type C test, the initial test will be performed on Unit 1 during the end of cycle 12 refueling outage, on Unit 2 no later than January 15, 1990, and during the end of cycle 11 refueling outage on Unit 3. On Units 2 and 3, until Type C testing is performed, these penetrations may be utilized provided that compensatory measures described in W. H. Owen's September 29, 1989 letter and H. B. Tucker's October 4, 1989 letter are implemented.
