The County Executive returned the resolution on July 23, 2015 neither approved nor disapproved. The Rockland County Charter Section C2.02 states that, if within twenty-one days the County Executive neither approves nor disapproves a legislative resolution sent to him for his signature, the resolution is deemed adopted as if he had signed it. A certified copy of the resolution is on file in my office.

Meyers, Co-Sponsor RESOLUTION NO. 361OF2015 OPPOSING INDIAN POINT'S LICENSE RENEWAL ON ACCOUNT OF 1) ITS VULNERABILITY TO POTENTIALLY DEVASTATING FIRES THAT COULD PRECIPITATE A CATASTROPHIC RADIOLOGICAL EVENT, 2) ITS LOCATION ON TWO FAULT LINES, AND 3) THE FAILURE TO ESTABLISH AN ADEQUATE EVACUATION PLAN; AND, SHOULD LICENSE RENEWAL BE CONSIDERED, URGING THE UNITED STATES NUCLEAR REGULATORY COMMISSION TO INCLUDE AN EVALUATION OF INDIAN POINT'S TRANFORMERS, SEISMIC CONDITIONS, AND EVACUATION PLANS AS CRITERIA FOR LICENSURE CORNELUDIAZ, LOW-HOGAN, PAUL: UNAN.

WHEREAS, a transformer fire occurred on May 9, 2015 at Indian Point 3 that placed the facility at risk of destruction leading to a catastrophic radiological event; and WHEREAS, a meltdown or catastrophic radiological fire could lead to millions of near and long-term deaths, cause millions of cases of chronic radiation sickness, devastate our region's economy, and could render large areas within the plant's fifty mile radius permanently uninhabitable; and WHEREAS, the transformer fire of May 9, 2015 led to an unacceptable dielectric fluid spill into the Hudson River, and the broader environmental impact is as yet unknown:

and

  • WHEREAS, the transformer that failed was a replacement for a transformer that similarly caught fire in 2007, and there have now been three (3) such fires since 2007; and WHEREAS, spent nuclear fuel pools at Indian Point are overpacked, increasing the risk of massive destruction by fire at the facility; and WHEREAS, it is estimated that Indian Point has a mere twenty-four (24) minutes of fire protection on account of defective and insufficient insulation; and

WHEREAS, Indian Point 2 is currently operating without a license, and the license for Indian Point 3 expires in December of 2015; and WHEREAS, the United States Nuclear Regulatory Commission's (NRC) criteria for Indian Point's licensure renewal does not include an assessment of the health of its transformers, and the NRC has thus far refused to grant New York State's request to include transformers under Indian Point's "Aging Management Plan;" and WHEREAS, although Indian Point is located on two fault lines, and although an earthquake could place our population at grave risk of a catastrophe, the NRC nonetheless omits seismic conditions from its re-licensing checklist; and WHEREAS, furthermore, the re-licensing process does not take into consideration a successful evacuation plan with an adequate escape route for citizens whose lives would be endangered in an emergency; and WHEREAS, the NRC has inexplicably placed the commercial interests of plant owner Entergy before the health and safety of our citizens; and WHEREAS, the Environmental Committee Commi.ttee of the Legislature of Rockland County has met, considered and by a unanimous vote approved this resolution; now therefore be it RESOLVED, that the Legislature of Rockland County opposes Indian Point's license renewal on account of 1) its vulnerability to potentially devastating fires that could precipitate a catastrophic radiological event, 2) its location on two fault lines, and 3)the failure to establish an adequate evacuation plan; and be it further RESOLVED, that should the United States Nuclear Regulatory Commission consider renewing Indian Point's licenses, the Legislature of Rockland County urges the NRC to include an evaluation of Indian Point's transformers, seismic conditions, and evacuation plans as criteria for licensure; and be it further RESOLVED, that the Clerk to the Legislature be and he is hereby authorized and directed to send a copy of this Resolution to Hon. Barack H. Obama, President of the United States; Dr. Ernest Moniz, Secretary of the United States Department of Energy; Stephen G. Burns, Chairman, United States Nuclear Regulatory Commission; Hon. Charles Schumer and Hon. Kirsten Gillibrand, United States Senators; Hon. Nita M. Lewey, Member of the United States Congress; the President Pro Tern of the United States Senate; the Speaker of the United States House of Representatives; the Majority and Minority Leaders of the United States Senate and House of Representatives; Hon. Andrew M. Cuomo, Governor, State of New York; Hon. David Carlucci, Hon. William J. Larkin Jr., New York State Senators; Hon. Kenneth P. Zebrowski, Hon. Ellen C. Jaffee, Hon. James G. Wolfe, Co-Sponsor RESOLUTION NO. 364 OF 2015 URGING THE UNITED STATES NUCLEAR REGULATORY COMMISSION, THE FEDERAL EMERGENCY MANAGEMENT AGENCY AND NEW YORK STATE TO REQUIRE INDIAN'-POINT OWNER ENTERGY TO PROVIDE AT NO COST TO THE COUNTIES AN EMERGENCY NOTIFICATION SYSTEM OF EMAILS, TEXT MESSAGES AND AUTOMATED PHONE CALLS TO CITIZENS WITHIN A TEN (10) MILE RADIUS OF INDIAN POINT FOR USE BY THE FOUR (4) COUNTIES SURROUNDING INDIAN POINT IN THE EVENT OF ANY INDIAN POINT-BASED EMERGENCY THAT COULD AFFECT THE GENERAL PUBLIC EARL/CAREY, DIAZ, GRANT, HOFSTEIN, LOW-HOGAN, PAUL: LINAN.

WHEREAS, Indian Point Energy Center is located within 10 miles of Rockland County; and WHEREAS, The Federal Government has established through regulations that Counties located within ten (10) miles of nuclear power plants are required, as a condition of licensing, to have emergency plans in place to protect residents; and

  • WHEREAS, plant conditions may be present that could release radioactive materials into the surrounding areas that would require the public in Rockland, Orange, Dutchess and Putnam Counties to take action for protection; and WHEREAS, as required by regulation, Indian Point has installed an outdoor siren warning system to notify residents that actions on their p~rt may be required to protect themselves; and WHEREAS, the United States Nuclear Regulatory Commission's {NRC's) criteria for Indian Point's licensure renewal does not include an emergency notification system

that includes emails, text messages and automated phone calls to all citizens within ten (10) miles of Indian Point; and WHEREAS, to date neither the United States Government nor New York State has required Entergy to implement a notification procedure for

  • Indian Point Emergencies that includes emails, text messages and automated phone calls to citizens within ten (10) miles of Indian Point; and WHEREAS, a broad-based emergency alert system is needed to advise citizen within ten {10) miles of Indian Point to emergencies that could affect the general public, be they catastrophic radiological events or environmental disasters, using the most current technologies available; and WHEREAS, the Public Safety Committee of the Legislature of Rockland County has met, considered and by a unanimous vote approved this resolution; now therefore be it RESOLVED, that the Legislature of Rockland County urges the United States Nuclear Regulatory Commission, the Federal Emergency Management Agency and New York State to require Indian Point owner Entergy to provide at no cost to the counties an emergency notification system of emails, text messages and automated phone calls to citizens within a ten (10) mile radius of Indian Point for use by the four (4) counties surrounding Indian Point in the event of any Indian Point-based emergency that could affect the general public; and be it further RESOLVED, that the Clerk to the Legislature be and he is hereby authorized and directed to send a copy of this Resolution to Hon. Barack H. Obama, President of the United States; Dr. Ernest Moniz, Secretary of the United States Department of Energy; Stephen G.
