Title:

The staff solicited stakeholder comments on the draft Environmental Impact Statement (EIS) which was prepared in response to a construction permit application submitted by SHINE Medical Technologies, Inc. (SHINE) for its proposed medical radioisotope production facility.
The staff will evaluate comments received both at these meetings and any others received during the comment period, which ends July 6, 2015. The draft EIS will be revised as appropriate based on the comments received. Responses to all comments received will be included in Appendix A of the final EIS.
General Details:
The U.S. Nuclear Regulatory Commission (NRC) held two identical meetings to accommodate interested persons, one in the afternoon and the other in the evening. Both meetings were preceded by an informal open house beginning one hour prior to the meeting where members of the public had the opportunity to meet with NRC staff and to ask questions related to the construction permit process. The afternoon meeting was scheduled from 2:00 p.m. - 4:00 p.m. CST. The evening meeting was scheduled from 7:00 p.m. - 9:00 p.m. CST. Ten NRC staff members were present. The meetings were facilitated by Ms.
Alison Rivera, an NRC in-house facilitator. The meetings began with an introduction of NRC staff, Department of Energy staff, and a review of meeting ground rules. This was followed by a presentation on the construction permit process and the findings in the SHINE draft EIS by Ms. Michelle Moser. The presentation emphasized that the review process was not yet complete and comments were welcome on the draft EIS. Lastly, the formal comment portion of the meeting was held during which attendees were invited to provide comments on the meeting record.
Approximately 35 people participated in the afternoon and evening meetings. One meeting participant provided comments in the afternoon session, and no participants provided comments in the evening session. In addition to members of the public, meeting participants included representatives from Congressman Paul Ryans office, the Department of Homeland Security, State Representative Debra Kolste (Assembly District 44), Wisconsin Department of Natural Resources, Wisconsin Emergency Management, Wisconsin Department of Health Services, the City of Janesville, Mercy Hospital System, Argonne National Laboratory, NorthStar Medical Radioisotopes, and the applicant.
Summary of Presentation:
Both meetings consisted of two parts. The first part was a presentation by Ms. Moser discussing: (1) the NRCs regulatory role, (2) the preliminary findings of the environmental review as described in the draft EIS, and (3) the current schedule for the remainder of the environmental review and how comments can be submitted. The second part was a public comment period.
A summary of Ms. Mosers presentation follows: The NRC staff conducts environmental reviews for applicants that submit a construction permit application. NRCs construction permit review for SHINE addresses safety issues related to construction of the proposed facility and environmental issues related to the construction, operation, and decommissioning of the proposed facility. The environmental review performed by the NRC staff resulted in the environmental impact findings shown in the table.

Cumulative impacts include the effects on the environment from other past, present, and reasonably foreseeable future human actions.
These effects not only include the construction, operation, and decommissioning of the proposed SHINE facility but also impacts from activities unrelated to SHINE, such as future urbanization or climate change. The cumulative impacts on all resource areas were found to be SMALL with the following exceptions: (1) the cumulative impacts on ecological resources could be MODERATE primarily due to agricultural runoff and climate change and (2) the cumulative impacts on transportation could be SMALL to MODERATE primarily due to additional traffic associated with the SHINE project.
The National Environmental Policy Act (NEPA) mandates that each EIS consider alternatives to any proposed major Federal action. The NRC staff considered the environmental impacts associated with constructing the SHINE facility at two alternatives sites (Stevens Point and Chippewa Falls) and constructing an alternative technology (a linear-accelerator-based facility) at the Janesville site. Additionally, the NRC staff considered the no-action alternative if the NRC
denied the construction permit. The NRC staffs preliminary conclusion is that after weighing the environmental impacts and considering reasonable alternatives, the NRC staff recommends the issuance of the proposed construction permit to SHINE, unless safety issues mandate otherwise.
It was stated that comments received by the end of the comment period on July 6, 2015, would be considered by the NRC staff in developing the final EIS. The final EIS will contain the staffs final recommendation on the acceptability of issuing the construction permit based on the work already performed and any relevant information received during the comment period.
Public Participation Themes:
At the meetings, commenters raised the following concerns: (1) accidents involving aircraft collisions could occur due to the proximity of the proposed site with an airport; (2) an alternative site exists where SHINE could build the facility; and (3) general opposition to granting the construction permit primarily due to safety concerns. Next Step:
NRC staff will address the comments provided during this meeting as part of the construction permit process for SHINE. A record of how each comment was addressed will be included in Appendix A of the final EIS.
