INDIAN POINT NUCLEAR GENERATING UNIT NO. 3 -WITHDRAWAL OF REQUEST FOR RELAXATION OF THE SCHEDULE REQUIREMENTS FOR ORDER EA-12-049, "ISSUANCE OF ORDER TO MODIFY LICENSES WITH REGARD TO REQUIREMENTS FOR MITIGATION STRATEGIES FOR BEYOND-DESIGN-BASIS EXTERNAL EVENTS" (TAC NO. MF0745)

Dear Sir or Madam:

By letter dated March 12, 2012 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML12054A735), the U.S. Nuclear Regulatory Commission (NRC) ordered Entergy Nuclear Operations, Inc. (Entergy, the licensee) to take certain actions at Indian Point Nuclear Generating Unit No. 3 (IP3), associated with the Fukushima Near-Term Task Force Recommendations. Order EA-12-049 directed that actions be taken by licensees to develop and implement strategies to maintain or restore core cooling, containment, and spent fuel pool (SFP) cooling capabilities during beyond-design-basis external events.

Section IV of the order states that licensees proposing to deviate from requirements contained in NRC Order EA-12-049 may request that the Director, Office of Nuclear Reactor Regulation, relax or rescind certain requirements. By letter dated January 28, 2015 (ADAMS Accession No. ML15034A506), Entergy submitted a request for IP3 for relaxation of the schedule requirement for full implementation of the order, due to a potential difficulty in installing a plant modification related to the order prior to the compliance date.

By letter dated March 16, 2015, Entergy retracted the relaxation request, stating that the plant modification has been accomplished.

The purpose of this letter is to advise that the above-cited request for relaxation from NRC Order EA-12-049 is being treated as withdrawn. The full order implementation date for IP3 remains the completion of the spring 2015 refueling outage, as specified in Order EA-12-049.
