Lisa, As we discussed on our call today, I still have concerns with the GEH proprietary claims with the documents from the February 20, 2014 supplement to the LaSalle UHS license amendment request. By letter dated December 4, 2014, the NRC staff issued a request for additional information (RAI) regarding the withholding request. Although Exelons December 18, 2014, and January 23, 2015, response to the RAI addressed some of the concerns, the revised GEH affidavit lacks specificity to address many of the RAIs.

I note that the information claimed to be proprietary is limited to the following sections of the UHS heat load calculation, L-002453, Revision 4:

Tables 7.1 and 7.2 - decay heat load tables Attachment A (GE Letter NSA-01-404, GE-LPUP-024, and GE-LPUP-204)

Attachment B (SEAG #12-000098, which includes the April 18, 2012, GEH letter)

Attachment C (Excel Spreadsheet formulas for Tables 7.1 and 7.2)

Attachment E (MATHCAD Printout)

In RAIs 7 and 8, it was noted that the information claimed to be proprietary in Tables 7.1 and 7.2 and in the Excel files contained in Attachment C can easily be derived from publicly available information.

I have discussed the UHS heat load calculation with the NRC technical staff and confirmed that the SE will not rely on the information in Attachments A, B, and E (i.e., the GEH letters and the MATHCAD printout).

Exelon should provide a revised response to the NRC staffs December 4, 2014, RAI by March 4, 2014. If a revised response resolving the proprietary issues is not provided by this date, it may delay the completion of the NRC staffs review of the amendment and may result in a denial of the GEH request to withhold information from public disclosure. If needed, the staff may follow up on this email with a letter to provide more details.
