SAN ONOFRE NUCLEAR GENERATING STATION UNITS 2 AND 3-TERMINATION OF EMERGENCY RESPONSE DATA SYSTEM FEED TO THE U.S. NUCLEAR REGULATORY COMMISSION

Dear Mr. Palmisano:

This letter serves to acknowledge that the Emergency Response Data System (EROS),

including the Southern California Edison Company (SCE) EROS data link from the San Onofre Nuclear Generating Station (SONGS), Units 2 and 3, to the U.S. Nuclear Regulatory Commission (NRC) Operations Center, is no longer required based on the permanently shutdown and defueled condition of your facility.

Section VI of Appendix E to Part 50 of Title 10 of the Code of Federal Regulations (10 CFR) establishes the requirement for a nuclear power reactor licensee to have a real-time electronic data link from the licensee's onsite computer system to the NRC Operations Center that provides for the automated transmission of a limited data set of selected parameters. However, Section Vl.2 of Appendix E to 10 CFR Part 50 specifically exempts from the requirement to maintain the EROS data link with the NRC those nuclear power facilities that have permanently or indefinitely shut down.

By letter dated June 12, 2013 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML131640201), SCE submitted to the NRC a certification, under 10 CFR 50.82(a)(1 )(i), indicating that it had permanently ceased power operations at SONGS Units 2 and 3, effective June 7, 2013. On June 28, 2013, SCE submitted a certification of permanent removal of fuel from the SONGS Unit 3 reactor vessel under 10 CFR 50.82(a)(1 )(ii)

(ADAMS Accession No. ML13183A391). On July 22, 2013, SCE submitted a certification of permanent removal of fuel from the SONGS Unit 2 reactor vessel under 10 CFR 50.82(a)(1 )(ii)

(ADAMS Accession No. ML13204A304). Upon docketing of these certifications, the 10 CFR Part 50 licenses for SONGS Units 2 and 3 no longer authorize operation of the reactors or emplacement or retention of fuel into the reactor vessels, as specified in 10 CFR 50.82(a)(2).

As such, SCE is in the process of terminating the EROS data transmission link to the NRC for SONGS Units 2 and 3.

Based on the certification of the permanently shutdown and defueled condition of the SONGS Units 2 and 3 reactors, the NRC acknowledges that SCE is no longer required to maintain the SONGS Units 2 and 3 EROS in accordance with Section Vl.3 of Appendix E to 10 CFR Part 50.

The NRG requests that SCE return any NRG-provided hardware or software in support of the EROS link within 90 days of the date of this letter, or as soon as reasonably practical.
