BRUNSWICK STEAM ELECTRIC PLANT, UNIT NOS. 1 AND 2, AND SHEARON HARRIS NUCLEAR POWER PLANT, UNIT NO. 1-ACCEPTANCE OF REQUESTED LICENSING ACTION RE: APPLICATION FOR ORDER APPROVING TRANSFER OF CONTROL OF LICENSE AND FOR CONFORMING LICENSE AMENDMENT PURSUANT TO 10 CFR 50.80 AND 10 CFR 50.90 (TAC NOS.

MF5505, MF5506 AND MF5507)

Dear Mr. Ernest J. Kapopoulos:

By letter dated December 22, 2014 (Agencywide Document Access and Management System Accession No. ML14358A253), Duke Energy Progress, Inc. (Duke Energy), and North Carolina Eastern Municipal Power Agency (NCEMPA), submitted a request, in accordance with 10 CFR 50.80, to transfer to Duke Energy the interests currently held by NCEMPA in Renewed Operating License Nos. DPR-71 and DPR-62 for the Brunswick Steam Electric Plant Unit Nos. 1 and 2, and Renewed Operating License No. NPF-63 for the Shearon Harris Nuclear Power Plant, Unit 1. As operating licensee, Duke Energy will also continue to be responsible for the safe and economic operation of the units. Pursuant to 10 CFR 50.90, Duke Energy also requested approval of changes to each of the Renewed Operating Licenses to reflect the proposed transfer to be issued and made effective at the time the transfers occur. The purpose of this email is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this Order application and amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.
