ANNUAL CERTIFICATION OF FINANCIAL ASSURANCE FOR FISCAL YEAR 2013: PENNSYLVANIA STATE UNIVERSITY (TECHNICAL ASSIGNMENT CONTROL NUMBER L33304)
Dear Mr. Doncsecz:
In letters dated December 20, 2013, and January 15, 2015, Pennsylvania State University (PSU) submitted its annual certification to demonstrate continued eligibility to use the self-guarantee for financial assurance of decommissioning both the Breazeale Nuclear Reactor (Docket 050-0005) and Special Nuclear Material (Docket 70-113). The information reviewed by the staff at the U.S. Nuclear Regulatory Commission (NRC) is for fiscal year 2013.
Nuclear facilities licensed under Title 10 of the Code of Federal Regulations (10 CFR) Parts 50 and 70 are required to establish adequate financial assurance for decommissioning, decontamination, and reclamation pursuant to 10 CFR Section 50.25, Reporting and Recordkeeping for Decommissioning Planning and 10 CFR 70.25, "Financial Assurance and Recordkeeping for Decommissioning." Sections 50.25 and 70.25 of 10 CFR require that non-profit college and university licensees that utilize a self-guarantee provide reasonable assurance of available funds for decommissioning costs. Furthermore, on an annual basis, such licensees are also required to provide a self-guarantee agreement and pass a financial test pursuant to Appendix E to 10 CFR Part 30, Criteria Relating to Use of Financial Tests and Self-Guarantees For Providing Reasonable Assurance of Funds For Decommissioning by Nonprofit Colleges, Universities, and Hospitals."
The NRC staff finds that PSU meets the requirements of 10 CFR Part 30, Appendix E, as documented in the encloser. The language of the self-guarantee, Controller Letter, and Audited Financial Statements, submitted by letter dated December 20, 2013, and opinion of the independent accountant of the off-balance sheet transactions, comply with applicable NRC regulations. The NRC staff has no further questions at this time.
This letter both concludes the action on the review of the annual certification and closes the assigned Technical Assignment Control Number L33304.
In accordance with 10 CFR 2.390 of the NRC's "Agency Rules of Practice and Procedure," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records System component of the NRC's Agencywide Documents Access and Management System (ADAMS).
