CATAWBA NUCLEAR STATION, UNITS 1 AND 2- ACCEPTANCE REVIEW OF LICENSE AMENDMENT REQUEST RE: MEASUREMENT UNCERTAINTY RECAPTURE POWER UPRATE (TAC NOS. MF4328 AND MF4329)

Dear Mr. Henderson:

By letter dated June 23, 2014, Duke Energy Carolinas, LLC (Duke, the licensee), submitted a license amendment request (LAR) for Catawba Nuclear Station. The proposed amendment would revise the maximum power level specified in each unit's operating license and the technical specifications (TSs) definition of rated thermal power. The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff's acceptance review of this LAR. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review.

The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (1 0 CFR), an amendment to the license (including the TSs) must fully describe the changes requested, and following, as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

On August 18, 2014, the NRC staff held a conference call with Duke staff to discuss supplemental information regarding environmental qualification of plant components that was needed to enable the NRC staff to begin its detailed technical review. Prior to issuance of a formal request for this information, and by letter dated August 26, 2014, Duke supplemented the subject LAR with the requested information.

K. Henderson The NRC staff has reviewed the supplemental information and concluded that it does provide

  • technical information in sufficient detail to enable the NRC staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the LAR in terms of regulatory requirements and the protection of the public health and safety and the environment.

The NRC staff intends to complete its review of the MUR LAR riine months from the date of the submittal. The review will be completed consistent with the guidance in NRC Regulatory Issue Summary 2002-03, "Guidance on the Content of Measurement Uncertainty Recapture Power Up rate Applications," dated January 31, 2002.
