NOTICE OF VIOLATION

(NRC INSPECTION REPORT NO. 50-261/88-32)

This refers to the Nuclear Regulatory Commission (NRC)

inspection conducted by

J. D. Ennis at the H. B. Robinson plant on November 2-3, 1988. The inspection

included a review of the circumstances surrounding a vital area access control

problem discovered and reported by the licensee on October 28,

1988.

The

report documenting this inspectionwas sent to you by letter dated November 16,

1988. As a result of this inspection, a sfgnificant failure to comply with NRC

regulatory requirements was identified, and accordingly, NRC concerns relative

to the inspection findings were discussed in an Enforcement Conference held on

December 8, 1988.

The letter summarizing this conference was sent to you on

December 20, 1988. The violation described in the enclosed Notice of Violation

involved a failure to provide adequate vital area access control.

The events

or circumstance that resulted in this violation included the failure of a

member of the security organization to remain alert and attentive to duty while

posted at an open vital area portal.

The plant was at power operating levels

at the time of the event.

In accordance with the "General

Statement of Policy and Procedure for NRC

Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violation described

in the enclosed Notice has been classified as a Severity Level IV violation.

While the failure of a security officer to perform assigned duties is of

significant concern, the unpredictability of the failure, in this particular

case, led to the categorization of the event as a Severity Level IV violation.

You are required to respond to this letter and the enclosed Notice and should

follow the instructions specified therein when preparing your response.

In

your response,

you should document the specific actions taken and any

additional actions you plan to prevent recurrence.

After reviewing your

response to this Notice, including your proposed corrective actions and the

results of future inspections, the NRC will determine whether further NRC

enforcement action is necessary to ensure compliance with NRC regulatory

requirements.
