Dear Mr. Utley:

R. Diggs R. Ballard By letter dated January 17, 1983, in accordance with 10 CFR 20.302, you requested approval of a proposed disposal procedure for slightly contaminated sediment from two settling ponds within the H. B. Robinson plant restricted area. The proposed disposal procedure involves the transfer, by hydrovacuum truck, of the sediment contaminated by Co-60 to an adjacent fossil plant ash pond that is within the owner controlled area. Your letter also requested blanket approval for such transfers whenever the concentration of Co-60 does not exceed an average concentration of 3.0 x 10-5 v Ci/gm wet. In support of your request you provided with your request letter a safety analysis report entitled, "Request for Approval of Transfer of Contaminated Sediment to the H. B. Robinson Ash Pond." In this report you provided a description of the licensed material and other radioactive material involved, the proposed manner and conditions of disposal, an analysis and evaluation of information pertinent to the nature environment potentially affected, and procedures to be observed to minimize the risk of unexpected or hazardous exposures.

We have completed our review of your report and request, submitted by your letter dated January 17, 1983, and we conclude that there will be no change in the conclusion or evaluations given in the H. B. Robinson, Unit No. 2, FES in regard to radiological impacts on man and biota due to the proposed transfer of contam inated sediment from the settling ponds to the ash pond and that there will be no significant environmental impact attributable to the proposed procedure.

Therefore, we conclude that your proposed procedure is acceptable. However, your request for blanket approval for such future transfer of radioactive material when the concentration of Co-60 does not exceed an average concentration of 3 x 10-5 p Ci/gm wet is not acceptable at this time. We will consider this request when we receive the results of your recently initiated environmental radiation monitoring program for the H. B. Robinson Ash Pond (pond surface water, ash, soil, and aquatic vegetation samples) and we complete our analysis and evaluation of the monitoring results.
