Letter from P. W. Howe to H. R. Denton, Subject, "Unresolved Safety Issues A-47 and A-49," dated July 7, 1982 In response to your letter dated July 7, 1982, and regarding our meeting with CP&L representatives on July 19, 1982, we believe that these discussions regarding your participation in the resolution of USI A-47 and A-49, for H. B.
Robinson Steam Electric Plant, Unit No. 2, have been very productive. We agree in general with your conditions for participation in the study as described in your letter of July 7 with the following clarifications. These are keyed to the paragraph numbers in your letter of July 7.
- 1. We are pleased to have CP&L participation and technical input in the A-49 study. The technical data you provide we understand will be based on readily available information and, despite reasonable efforts for accuracy, the data may contain errors.
- 2. The NRC project manager for this study is Carl Johnson, Division of Risk Analysis, Office of Nuclear Regulatory Research, (301) 443-5921.
- 3. We welcome your offer to provide data derived from your PTS project with NSAC.
4 and 6. Regarding CP&L review and comment on reports by the ORNL/INEL study team, we encourage your participation and offer you the same opportunities for comment we provide to the NRC staff. NRC will review plans and progress periodically during the study, and we invite your participation.
Upon completion of significant portions of the study, the study team will issue letter reports. These we will circulate to the NRC staff and to you for comment. The final report we will receive initially in draft form. If you disagree with the final report, you may write a foreword for inclusion in the published version. We want to ensure peer review to enhance the accuracy of the study, but we must avoid censorship to protect the integrity of the technical work.

- 5. With regard to your request for direct funding or reimbursement in connection with your effort on A-49, we cannot provide such a commitment at this time. However, we would be willing to discuss this matter in the future if a situation should develop requiring significant information not normally available to a licensee.
- 7. On the matter of the applicability of plant-specific results, we believe that it would be appropriate to use generic criteria for screening purposes.
Analysis available from work performed in support of A-49 would be acceptable in satisfying plant-specific requirements.
8 and 9. We propose review meetings to review progress, plans, and schedules.
Regarding the schedule for the ORNL/INEL study of pressurized thermal shock (A-49) at H. B. Robinson, in order to provide efficient time phasing between the three ORNL studies, e.g., Oconee, Calvert Cliffs and H. B. Robinson, we propose to begin the information-gathering phase in November 1982 and to complete the analysis in May 1984. If this is acceptable to you, we would like to discuss the detailed plans and schedule with you at the first review meeting with the ORNL/INEL study team in November 1982, With regard to USI A-47 we agreed, during our July 19, 1982 meeting, to refine our approach to this program and to define more carefully the information that would be needed from you. Although you have declined participation for now, your representatives at the July 19 meeting agreed that when our refined program plan is completed you would review it and perhaps reconsider your decision to participate in A-47.
