ENCLOSURE 1 NOTICE OF VIOLATION Carolina Power and Light Company Docket No. 50-261 H. B. Robinson License No. DPR-23 During the NRC inspection conducted on June 11 - July 10, 1989, a violation of NRC requirements was identified.
In accordance with "General Statement of Policy and Procedure For NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1989), the violation is listed below:
10 CFR 50 Appendix B Criterion III requires that measures shall be established.to assure regulatory requirements, as specified in the license application, are correctly translated into specifications, procedures and instructions. Additionally, it requires that design control measures shall provide for verifying the adequacy of design and shall be applied to accident analysis.
The overtemperature delta temperature (OT delta T) and overpower delta temperature (OP delta T) protective instrument settings for reactor trip are regulatory requirements of Technical Specifications 2.3.1.1.2.d and 2.3.1.1.2.e, respectively.
The OT delta T protective instrument setting is used in accident analysis to ensure a control rod drop accident doesn't result in a departure from nucleate boiling ratio (DNBR) of less than 1.17.
Contrary to the above, design control measures were inadequate:
- 1. For verifying adequacy of design for the OT delta T protective instrument setpoints, in that, from 1975 to December 1987, the OT delta T setpoints were not established to prevent a control rod.drop accident from resulting in a DNBR of less than 1.17.
- 2.
For assuring regulatory requirements were correctly translated into procedures and instructions, in that, from February 25, 1989, to April 3, 1989, the OP delta T instrument setpoints were outside the value required by Technical Specification 2.3.1.1.2.e.
This is a Severity Level IV Violation (Supplement I).
Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN:
Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, H. B. Robinson within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:
(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full 5000261 PDiC
Carolina Power and Light Company-2 Docket No. 50-261 H. B. Robinson License No. DPR-23 compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
