COMMENTS ON THE ELECTRIC POWER RESEARCH INSTITUTE REPORT 3002002276, PLANT SUPPORT ENGINEERING: COUNTERFEIT AND FRAUDULENT ITEMS - MITIGATING THE INCREASING RISK

Dear Mr. Bell:

The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the Electric Power Research Institute (EPRI) Report 3002002276, Plant Support Engineering: Counterfeit and Fraudulent Items - Mitigating the Increasing Risk, which the Nuclear Energy Institute (NEI) submitted on October 17, 2013 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML13301A634). The report provides necessary fundamental elements for developing a counterfeit and fraudulent items program appropriate for detecting and preventing such items from entering NRC regulated activities.

An April 14, 2014 letter from NEI (ML14105A203) states that EPRI plans to publish its updated guidance for counterfeit and fraudulent items by July 2014. That letter also stated that NRC feedback received before April 30, 2014, might be considered before publishing the EPRI guidance. The staff has identified a number of recommendations for changes and some areas that need further clarification to meet the objectives of an effective program for counterfeit and fraudulent items subject to NRCs regulatory authority. These comments and recommendations are set forth in the enclosure. The staff intends to discuss these topics at a public meeting scheduled for May 22, 2014.
