Our letter dated August 21, 1985, informed you that we were actively working with the staff of the Office of Nuclear Reactor Regulation (ONRR) on fee determinations for certain applications filed by your Company prior to June 20, 1984, that are subject to the March 23, 1978 Part 170 fee requirements. We have now completed a fee analysis of these applications for the San Onofre Nuclear Generating Station (Unit Nos. 1, 2 and 3).
While there are some remaining applications for which we do not yet have final fee determinations from the ONRR review staff, basically because final review has not yet been completed, we feel that we have reviewed the majority of them.
The enclosed list reflects each application, any fees paid and the ONRR staff's final fee determination and action on each.
As a result of the analysis, we find that a sum of $10,100 is due the NRC. It is requested that your Company remit this amount to our office to complete the fee requirements of 10 CFR 170 for the analyzed applications. We have been informed by the ONRR staff that no review was done nor will be done for those applications or portions of applications identified as items 5, 6.a., 7, 9.b., 12.b. and 16.h. of the enclosed list. Under the pro visions of 10 CFR 170.12(a), the USNRC may retain fees for applications regardless of their final disposition. However, it has been NRC policy to exempt from fees applications filed prior to June 20, 1984, on which no review has been done and none is planned.
It is also current NRC policy to exempt from fees applications filed prior to June 20, 1984, which are approved pursuant to 10 CFR 50.12 or other regulation exemption provisions such as 20.501, 73.5, 70.14, etc., when no license amendment is issued or no other provision in the regulations such as 50.48 and OPPICE AO OOo6 PD1 7120470 PDR21ADOO 851206 OFFIE1p C K 05000206 PDR U.................

Consequently, we have concluded that exemptions pursuant to 10 CFR 170.11(b), from the fee requirements of the March 23, 1978 regulations are authorized by law and such exemptions are otherwise in the public interest and are hereby granted for those applications and/or portions of applications identified on the enclosed list as items 5, 6.a., 7, 9.b., 12.b., 14 (approved pursuant to 10 CFR 70.14) and 16.h.
In instances where review of applications on the enclosed list is still pending and the final review reveals that the fees paid or being requested are incorrect, you will be notified and any necessary adjustments will be made.
