ALLEGED DISCRIMINATION AGAINST AN EMPLOYEE FOR HAVING ENGAGED IN PROTECTED ACTIVITIES (HAROLD J. LEIDER) Gentlemen: This refers to your letters dated January 26, 1990 in response to our letter dated December 27, 1989, concerning the alleged discrimination against an employee for having engaged in protected activities. Specifically, Dr. Harold J. Leider alleged that he was terminated from his position of staff physician at San Onofre because he had raised concerns about the adequacy of the SONGS-substance abuse program. After reviewing the information provided and becaue of the circumstances of this case, we have determined that enforcement action will not be taken at this time. No response to this letter is required. In accordance with Section 2.790 of the NRC's "Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter will be placed in the NRC Public Document Room. Sincerely, J.
