Dear Sir or Madam:
On January 27, 1988, Dr. Harold J. Leider, a former SCE employee at San Onofre Nuclear Generating Station, filed against SCE in California Superior Court for wrongful termination of employment. His complaint in that action alleged that he had been terminated because he had expressed to SCE his concern that SCE "needed to tighten its policies and procedures to make sure that the safety of those working at San Onofre and the safety of the public... was not being compromised by employees with substance abuse problems who had access to sensitive areas within the facility."
While Dr. Leider did not file a complaint with the U.S. Department of Labor under Section 210 of the Energy Reorganization Act, and while we understand that the action has been settled, our review of the complaint filed in the state court raises a concern that there may have been a violation of 10 CFR 50.7 which could have a chilling effect on other licensee or contractor personnel.
Therefore, you are requested to provide this office, within 30 days of the date of this letter, a response which:
- 1. Provides the basis for the employment action regarding the former employee and includes a copy of any investigation reports you have regarding the circumstances of the action;
- 2. Describes the actions, if any, taken or planned to assure that this employment action does not have a chilling effect in discouraging other licensee or contractor employees from raising perceived safety concerns; and
- 3. Provides a copy of the agreement between SCE and Dr. Leider that settled the dispute.
After reviewing your response, the NRC will determine whether enforcement action is necessary at this time to ensure compliance with regulatory requirements.
